How to file a complaint with the FCC against Fox News XXX

    To Whom It May Concern,

    Recently, the Fox News Channel covered a segment on protecting Children from Pornography.  Apparently, the channel felt that showing a screenshot of a pornography website was an acceptable visual for the segment.  While a woman's breasts are censored, a man's penis penetrating a vagina is not.  This is unacceptable.  I trust the FCC will take appropriate action and fine the FNC as this obscenity, whether intended or accidental, is a violation of federal law.

      A: Yes. Both 47 U.S.C. §559 and 18 U.S.C. §1468(a) respectively bar the transmission of obscene material over a cable system and the knowing utterance or distribution of obscene matter by means of a cable television system or subscription service.

      The Supreme Court established the FCC's jurisdiction over cable in United States v Southwestern Cable all the way back in 1968.

      right to take away broadcast licenses from cable, since they do not require them, but these statutes appear to allow enforcement of obscenity law...might be another enforcement entity, we should complain to local Attorney General for the appropriate cable systems.  (mine is Eliot Spitzer - Go Get 'em El!)

    Note the directions on the FCC web site.  You MUST include the time and date that the violation occured or your complaint won't be valid.

    Information regarding the details of what was actually said (or depicted) during the allegedly indecent, profane or obscene broadcast. There is flexibility on how a complainant may provide this information. The complainant may submit a significant excerpt of the program describing what was actually said (or depicted) or a full or partial recording (e.g., tape) or transcript of the material.

    The date and time of the broadcast. Under federal law, if the FCC assesses a monetary forfeiture against a broadcast station for violation of a rule, it must specify the date the violation occurred. Accordingly, it is important that complainants provide the date the material in question was broadcast. A broadcaster's right to air indecent or profane speech is protected between the hours of 10 p.m. and 6 a.m. Consequently, the FCC must know the time of day that the material was broadcast.

    Dear Fox News,

    After investigating numerous complaints, the FCC has determined that Fox News properly concealed the breasts of the woman in question, much like the draped statues at the Department of Justice, but unlike CBS at the Super Bowl.  The other uncovered body parts in question were determined to have educational value in demonstrating to the viewer what hard-core pornography is.  Therefore, the FCC is dropping the matter without imposing any sanction upon Fox News.

    outraged housewife tone, a la that idiot in Michigan who turned "Married With Children" into a hit.  To wit:

    Last night Fox News Channel ran a commercial for Neil Cavuto's show, which would be discussing the Supreme Court's ruling on Internet Porn.

    Fox proceeded to show a still photo onscreen of an Internet porn ad.

    While they thoughtfully blurred the naked breasts of the woman, they failed to disguise the ACTUAL PENETRATION OF A PENIS INTO HER VAGINA.

    THIS WAS ON TELEVISION. Not paid cable, but basic cable.
