Fitzgerald is by all accounts a extremely intelligent pitbull of a prosecutor. It boils down to this: Fitzgerald thinks that "classified" and "security clearance" have simple, definitive legal meanings. He is going to prosecute based on the legal code and the case. BushCO believes there is CLASSIFIED and classified information and security clearances can be granted whenever you leak information to a reporter. This is legal "classified" vs political "classified."
Fitzgerald is not a politician; he's a prosecutor who has hooked the BIG ONE. He lands this lunker and he will go down as the baddest prosecutor in history. From his perspective, the way politics is conducted in Washington is criminal and BushCO is going down as a result. Fitzgerald doesn't understand that there is a distinction between CLASSIFIED and classified. Mark it secret and leak it and you have committed a crime in Fitzgerald's world. It's the law, and Fitzgerald is going to follow the law. It may be common behavior, but it is a crime. Smoking pot is common behavior too, but you are still breaking the law and you will be prosecuted except in states that have decriminalized marijuana possession. Maybe BushCO should have decriminalized traitorous behavior?
If the politicians didn't want this behavior to be criminal, they should have passed different laws. Scofflaws can't complain when a prosecutor starts enforcing the law. Our politics are criminal and Fitzgerald is going to prosecute these scumbags.
It's ironic that a administration that has made almost everything classified is going to get burned for leaking something that is CLASSIFIED, i.e. a covert CIA agents identity.
