Boy it was fun writing that :)
Ok, my great weakness is schadenfreude but I prefer to think of it as belief in karma.
In a nutshell:
Many universities ban military recruiters on campus because the military is in violation of their anti-discrimination policies, specifically dont-ask-dont-tell.
The government is trying to force the universities to accept military recruiters, or lose all funding.
The universities are responding that they have the first amendment right to discriminate against the employers of which it disapproves.
The basis for this first amendment right is the recent Supreme Court decision that the Boy Scouts of America have the first amendment right to discriminate against those of whom it disapproves - gays.
The 3rd Circuit Court of Appeals accepted the analogy, holding that "just as the Boy Scouts believed that homosexual conduct is inconsistent with the Scout oath, the law schools believe that employment discrimination is inconsistent with their commitment to justice and fairness."
Makes the head swim, doesn't it.
For a great laugh, read the Slate article.
