The
South Florida Sun-Sentinel reports that attorneys for one of the accused murderers of former SunCruz owner Gus Boulis has subpoenaed Jack Abramoff and Adam Kidan to be questioned about Boulis' murder:
Fallen super-lobbyist Jack Abramoff and his former business partner soon will be subpoenaed by defense attorneys to give sworn statements in the Konstantinos "Gus" Boulis murder case.
The attorney for murder suspect Anthony "Big Tony" Moscatiello filed paperwork this week asking to question Abramoff and Long Island businessman Adam Kidan about the SunCruz Casino founder's gangland-style slaying. Broward Circuit Judge Michael Kaplan granted the request Thursday after prosecutors agreed to it.
More inside.
'Big Tony,' one of the accused, is a former associate of John Gotti and the Gambino crime family. Moscatiello and his daughter were paid $145k by Adam Kidan for catering and other services. One of the other defendents received approx. $100k from Kidan as well.
One of the prosecutors, Brian Cavanagh, hasn't ruled out additional charges in the case:
Kidan has not been eliminated as a suspect in the murder case, Cavanagh said.
"The point we made in court was we weren't saying he would be a suspect in place of the present defendants, it's a question of whether he will be an additional defendant," Cavanagh said. "All the defendants are innocent until proven guilty and certainly at the present time Mr. Kidan is not under indictment so there has not even been a formal allegation at this juncture."
The same goes for Abramoff, presumably.
Update [2006-3-24 17:15:3 by jorndorff]: In the case anyone's forgotten, the AP also notes:
As part of their federal plea deals, Abramoff and Kidan are required to cooperate with prosecutors in any state or federal investigation.
The three current defendants are trying to get the judge not to hold them without bail. However, this tidbit doesn't bode well for their defense:
Investigators have testified that records show that cell phones belonging to Ferrari and Fiorillo were within 500 feet of the Boulis murder scene moments after the killing and that one was used to call Moscatiello.
Postscript:
Will Kidan's and Abramoff's stories conflict? If so, they will have to jump through hoops for it not to negatively affect their respective plea deals. Both call for full and complete cooperation. Any obstruction of justice will not be taken lightly when sentenced. Though with Abramoff & Kidan to be sentenced in the SunCruz fraud case in Florida next Wednesday, it would be for federal prosecutors to decide.
