Private Lyndie England changed her plea to not guilty in the Abu Ghraib prison scandal. Kossaks are wondering what the next step is, and I can't help but wonder, does this open the door for higher-ups to be charged?
This is what caught my eye, from CNN (http://www.cnn.com/)
"The female soldier at the center of the Abu Ghraib prison abuse scandal, Pfc. Lynndie England, today changed her plea to not guilty after a judge ruled she could could not plead guilty and have witnesses tell the sentencing jury she was only following orders. The judge declared a mistrial and prosecutors will now decide whether to refile charges."
So... logic would have me believe that if she was only following orders, then someone else, higher up, was responsible for those orders, therefore, someone else is liable, and must stand trial.
Follow me here...
She was put on trial because what happened was WRONG. She pleaded guilty. Witnesses testified that she was only following orders and therefore, NOT guilty. The judge ordered that she could not plead guilty AND accept testimony that claimed she was innocent due to her following orders. If those orders were WRONG, and were the cause of what transpired then whoever issued those orders should have to stand trial for the illegality of those orders.
right?
