I found this reported at Positive Liberty.
Kansas had a case a while back where they jailed a 18 year old male (Matthew Limon) for having sex with a 14 year old male (they were actually 3 years 2 months in age difference). His sentence? 17 years. If the 14 year old was a female what would the 18 year old's sentence be? 15 months. The Kansas Supreme Court struck down the sentence as violated the principle of equal protection.. unanimously.
There is a new development in the case..
Update: After coming home and reading the comments, I have found the judge didn't force church attendence but rather allowed it since the uncle and aunt go to church. Some people didn't like the previous headline because they felt it was misleading. Sorry, from the first two stories I read it seem perfectly correct, It wasn't and its corrected. I still believe it is amazing that appeal to the Supreme Court is even being considered. No, the Kansas overturning was not the end of it if they haven't decided not to appeal.. so till they do, this is still outrageous.
First,
apparently the state government of Kansas might want to take this further, to the US supreme court. The 6 years that this young man has had to wallow in prison because he is gay (he would have been out 5 years ago if he were straight) is NOT ENOUGH. They want him to suffer another decade. Getting out of prison at 24 is not enough, they want to make him languish till he's 35.
During a sentencing hear Thursday afternoon - at which Limon was in orange prison clothes and shackled - the state indicated it may take the case to the US Supreme Court or file new charges.
Under Kansas law the attorney general has 30 days to decide whether to pursue the case against Limon.
God, does Kansas really want to cement their reputation as the American taliban state?
But it gets worse...
Apparently, the poor young man could be released pending the decision of whether to make his life even more hellish for another decade. At least he'd get a little freedom till they decided his fate. But a Kansas judge put very strict restrictions on his release:
Late Thursday night attorney Byron Cerrillo had completed the arrangements and Smith ordered Limon's release but under strict regulations.
He is to stay with an aunt and uncle and must work on their farm. He must attend church on Sundays.
apparently this news article and other have it wrong, the judge was allowing him to leave the home to go to church according to other reports linked in comments. Ignore the rest below. I'm leaving it so people understand the comments below
There is so much wrong with this. Is the judge trying to 'reform' him from his 'gay' ways?
and most egregious, has the judge never heard of the constitution and the separation of church and state?
As stated by the author, Kansas seems intent on adding outrage to an already outrageous situation.
