As everyone knows, CAFTA passed 217-215 shortly after midnight. 2 members were not recorded as voting: JoAnn Davis (R-VA) and Charles Taylor (R-NC). Taylor says he tried to vote "no" but that his vote was not recorded. That would make the vote 217-216.
Not much attention has been paid to JoAnn Davis. Where was she? The Boy Scout Jamboree! Because of traffic from that event and the weather, she didn't get back to Capitol Hill until 12:30 AM.
So, how would Davis have voted?
"She would have voted no," Connelly [her press secretray] said.

So, if she had voted, it would have been tied 217-217 and it would have theoretically. Now, we can assume that the Republicans would have found at least one other Robin Hayes to switch their votes, but still it would have been nice to see who they would find.
