The Case Against a "Fetal Homicide" Law

A private member's bill called The "Unborn Victims of Crime Act" has been introduced by Conservative MP Ken Epp (Edmonton Sherwood Park), and is scheduled for a Parliamentary vote in early March. The bill would amend the Criminal Code to allow separate homicide charges to be laid in the death of a fetus when a pregnant woman is attacked.
Five recent murder cases in Canada have involved a pregnant woman being murdered by a male partner or boyfriend. The victims and families of these horrific tragedies deserve our deepest sympathy, and they deserve justice. However, passing a "fetal homicide" law so that murder charges can be laid for the death of the fetus is not the way to go. Such a law would be an unconstitutional infringement on women’s rights, and would likely result in harms against pregnant women. It is a key step towards re-criminalizing abortion, but it could also criminalize pregnant women for behaviours perceived to harm their fetuses.
Epp, the MP introducing the bill is one of the most fervent anti-choicers in the Con party and that has alarm bells going off in the BQ party and the NDP.

Mr. Speaker, I am somewhat uncomfortable with this bill. I was listening before to the speech by the NDP member for Halifax and I agree with what she said.
As a Catholic priest, I find it somewhat difficult to relate to this bill quite simply because the member who tabled it belongs to a pro-life group, the Campaign Life Coalition, which, in my humble opinion, is a fairly extremist and fanatical group. I am pro-life, but I do not belong to that group.
In my opinion, this bill will open the door to recriminalizing women who have an abortion, and that is not a good thing. I am against abortion, but I do not believe that is how we will deal with the problem of abortion. I have always stated that we need education, support and assistance for women dealing with unwanted pregnancy. In my opinion, the problem of abortion will be solved with these types of measures and not by recriminalizing abortion. I absolutely do not want that.
Stephane Dion is the only opposition leader who has stated he will not whip the vote.
And as many of us in Canada are aware, the Liberals haven't been all that good at standing up against the Harper Conservatives. Some need to get their house in order I know.......But that should have been yesterday.
