The folks at SCOTUSblog have predicted, based on the distribution of opinions during the current Term thus far, that Justice Scalia will be writing the majority opinion in DC v. Heller. This almost certainly means that the Supreme Court will hold that the Second Amendment provides an individual right to bear arms, eviscerating the argument that the text is qualified to refer only to "well-regulated militias."
The remaining question is, how far will they go? Will Scalia hew to Chief Justice Roberts's policy of consensus around narrowly tailored legal issues? Or can Scalia get five votes for an opinion that eviscerates gun control as we know it?
