This election looks like the electoral vote may be a 269 to 269 tie.
Looking at the electoral map I see a scenario where it is very likely that the electoral college votes will result in a 269 to 269 tie. This sends the election to the new House of Representatives which means (if the 111th congress is similar to the 110th congress) Obama wins.
Here is the important language of the 12th Amendment:
The person having the greatest Number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the states, and a majority of all the states shall be necessary to a choice. And if the House of Representatives shall not choose a President whenever the right of choice shall devolve upon them, before the fourth day of March next following, then the Vice-President shall act as President, as in the case of the death or other constitutional disability of the President.
(Note that the 20th Amendment did change the date to January 20 from March 4)
Obama would win if the new congress (which will vote) is similar to this Congress because currently the Democrats control 27 state delegations and the Republicans 21 (Kansas and Arizona are a ties).Source from Wikipedia
How the right wing talkers will react will be so interesting. They thought nothing of the Supreme Court giving the White House to Bush so I wonder what they will say about the House of Representatives giving the White House to Obama? Will they remain peaceful? Will Bush act to remain in power? Will a Democrat not vote for Obama?
