It's scheduled for Conference on 12/12, which is ironic given the history around that date, the SCOTUS, and presidential elections.
At any rate, it shoud still be denied as it is nearly identical to what was denied earlier today (Donofrio v. Wells), so expect the final denial on 12/15 (the day the electoral college votes).
I wouldn't take any nefarious intentions out of the fact that it was Scalia who referred. This is pretty standard procedure to get these things off the docket.
