Here in all it's glory is a post from a non-political list I belong to that has a wide variety of political views represented.
Begin desperate whine from unreconstructed birth certificate doubter:
It appears that I "jumped the gun" a bit in my last post. It has been reported
that the decisions made by the Supreme Court in Conference last Friday, won't
be made public until tomorrow. So, then, the pre-inaugural Berg case, at
least, is still potentially "in play." We won't know till tomorrow. It would be
rather ironic if the man who swears-in Obama today (within an hour or so of
this writing) voted in Conference last friday to hear a case that could
ultimately lead to Obama's removal from office! I believe it will be Chief Justice
Roberts (reputedly a conservative) who will do the swearing-in.
And on it goes:
Once in office, it is my understanding that Obama, as President, will enjoy a
measure of immunity from lawsuits. Whether or not that includes Federal
lawsuits pertaining to his own qualifications to hold Executive office in the first
place, or not, I don't know. Previous cases of this sort have been denied on
the basis that the Petitioner lacked "standing," that is, he was not considered
by the Court to be legally entitled to bring suit. It has been reported that only
a Secretary of State of one of the 50 States, or a member of Congress,
has "standing" to bring such a case. If so, there remains the possibility of such
a suit sometime in the future, so long as there is just one Secretary of State,
or one Congressman, who is willing to do so--and if the President does not
enjoy immunity of the sort which would entirely preclude this. I surmise that a
member of the military could possibly bring such a suit, as well, inasmuch as he
would be directly and significantly impacted by the orders of his Commander-in-
Chief, and, seemingly (from my layman's perspective) would therefore have a
basis (or "standing") to dispute such orders, were there reasonable grounds to
question the Constitutional legitimacy of that Commander-in-Chief (members of
the military take a solemn Oath "to defend the Constitution against all
enemies, foreign and domestic").
Of course, I recognize that all of this is rather "pie in the sky," and highly
improbable.
Nonetheless, to dream is a sometimes pleasant pastime...
