Queensland Governor, Penelope Wensley, continues to doggedly ignore gross judicial misconduct allegations against her brother, Robert Wensley QC, a former Queensland Anti Discrimination Tribunal judge and three other Queensland judges and carries on as usual, treating the devastated victims with contempt and dispassionate indifference.
When Penelope Wensley was sworn in as the 25th Governor of Queensland, she and Labor Premier Bligh were well aware of the long standing judicial abuse and corruption complaint by Brisbane mother Jennifer Nash, involving four judges.
Robert Wensley QC was the judge presiding over the school bullying and education discrimination complaint of a 12 year old boy, who was consistently denied a legal youth advocate in breach of the Rights of the Child and the Queensland Anti Discrimination Act (1991) and forced to appoint his untrained mother, Jennifer Nash as his legal youth advocate.
After deliberating for 8½ months on the case, Robert Wensley QC dismissed the complaint and ordered the juvenile to pay Education Queensland more than $ 28,000 in legal costs.
He completely ignored points of law and their testimony that they had not returned to the Tribunal because they could no longer tolerate the abusive and harrowing QADT hearings without any legal protection.
Ms Nash believes the unlawful costs order is little more than a red herring designed to divert attention from the fact that, despite spending two years in a harrowing human rights process without legal youth advocacy, the case was never remedied and never heard. And the boy was forced to leave school due to the relentless school bullying.
The bullied schoolboy and his mother repeatedly complained that they were in fact also bullied by Robert Wensley QC, who was intimidating and refused to hear them in a marathon 7½ hour hearing where the law was repeatedly misapplied.
Premier Anna Bligh was the former Education Minister to whom Ms Nash had written many times, asking her to act on the school bullying to ensure her son would be able to complete his education. However Ms Bligh completely ignored her.
Ms Nash detailed the abuse she and her son suffered in the QADT in a radio call to former Radio 4BC Brisbane presenter, Chuck Brooks. https://publish.indymedia.org.uk/...
To date the allegations by Ms Nash and her son that they suffered a gross miscarriage of justice, judicial misconduct and that their courtroom audiotapes and transcripts were repeatedly edited in order to pervert the course of justice, remain unacknowledged as government apparently refuses to take a position one way or another vis-a-vis these serious allegations.
The other Judges mentioned in the documented and corroborated judicial abuse and corruption complaint by Ms Nash are former Queensland Anti Discrimination Tribunal President, Judge Jean Dalton QC, Queensland Supreme Court Judge, Ann Lyons and Queensland Supreme Court Judge, Roslyn Atkinson, who is also the Queensland President of the International Committee of Jurists.
"Equal treatment before the law is a pillar of democratic societies. When courts are corrupted by greed or political expediency, the scales of justice are tipped, and ordinary people suffer. Judicial corruption means the voice of the innocent goes unheard, while the guilty act with impunity" said Huguette Labelle, Chair of Transparency International.
When Governor Wensley was sworn in on July 29, 2008 at a cost of $80,000 in front of 480 selected guests, Queensland Premier Anna Bligh defended the expense, claiming the ceremony was important as it was not every day Queensland welcomed a new governor.
"This is an important role in a democracy. It's not a lavish affair but I think it is important that a formal ceremony be undertaken," Ms Bligh said.
She further enthused "Penelope Wensley is a distinguished Queenslander who has made her mark on the world stage and now she's coming home to serve our state. She will also bring a great warmth and compassion to the role of governor, having been involved in many humanitarian and environmental issues during her international career."
Governor Wensley herself claims to have a special interest in human rights and humanitarian matters but has not demonstrated this in the case of Ms Nash and her son.
She told media last year she believed "in due course the Australian people will decide they wish to become a republic, but they haven’t made that decision yet. Until such time as they do so, we have institutions and systems that need to be upheld and respected".
Yet it has become impossible for Queenslanders to respect the institution of the Constitutional Monarchy she represents, as it is not only very costly at over $ 4 million per annum, but also totally unaccountable and very undemocratic.
Recent revelations by Tony Fitzgerald QC of systemic government corruption and cronyism has angered disillusioned Queenslanders and the approval rating for Premier Anna Bligh has sunk to 33%, the lowest ever for a Queensland politician, but Governor Wensley has remained silent.
Former Labor minister, John Mickel is the Queensland Speaker of the House and Ms Nash is his constituent, but he continues to refuse to represent her and her son under the Westminster system of political accountability.
On 23 April 2009 Mr Mickel angrily ordered Ms Nash ejected from Parliament when she tried to address him and Premier Bligh from the public gallery of the Queensland Parliament on the issue of the miscarriage of justice, gross judicial misconduct and his failure to represent her as his constituent.
To Ms Nash’s disappointment, Parliament did nothing and did not express dismay or shock. At least one person actually laughed. Ms Nash believes it was the Premier, Anna Bligh.
Following Mr Mickel’s ejection order, Ms Nash was violently ejected and forced downstairs by an aggressive armed police officer who caused her bruises.
The whole incident was censored and never broadcast to the people who are completely unaware of what occurred and what was said in Parliament. The Bligh government has long banned television cameras from Parliament in its drive for complete secrecy and censorship. Ms Nash has been denied access to a video copy of the incident.
Queensland Attorney General, Cameron Dick, who was sworn into office in March 2009, continues to refuse to acknowledge Ms Nash and her son as Australian citizens with inalienable civil rights, including the right to public service in their own country.
On 30 June 2009 Ms Nash attended a community cabinet forum where she personally hand delivered a letter to Labor Prime Minister Rudd, asking him to personally intervene in this matter. She had contacted him many times previously, but never received a response.
On 10 August Ms Nash received a letter from Anna Bligh’s Senior Policy Advisor, informing her that Mr Rudd had referred her letter to him to Anna Bligh, who in turn referred it back to the "Honourable" Cameron Dick, who continues to ignore Ms Nash and her long suffering teenage son.
The offensive letter ends with "The Premier trusts this arrangement is satisfactory to you".
Premier Bligh had previously shirked all responsibility by referring Ms Nash’s corruption complaint to the previous Attorney General, the "Honourable" Kerry Shine, who just like the "Honourable" Mr Dick, refused to acknowledge the family and their right to public service in their own country service on equal terms.
Ms Nash and her son have joined a chorus of people, including politicians, police officers and members of the public demanding an urgent and independent Royal Commission into systemic Bligh government corruption.
Due to lack of press freedom this story has not been published in Australia, while Mathaba, The Wall Street Journal, USA Today, The Huffington Post and many others have reported it.
