The Brief contends that the 11th Circuit’s decision conflicts with Supreme Court precedent which states that there has to be an explicit quid pro quo connection between a payment and an official act in campaign contribution cases, to wit, an explicit promise agreement made in return for a contribution.
The 11th Circuit’s decision held that the explicit quid pro quo could be implied from the circumstances.
In this case, Richard Scrushy had donated money to Siegelman’s lottery initiative, and Siegelman reappointed Scrushy to the "CON" Board.
The Attorneys General argued that the 11th Circuit’s decision treats campaign donations like any cash pay-off and thus infringes upon the democratic process, and makes it easier to abuse the system by prosecuting political rivals.
