How is he different than the Gitmo detainees? Is this an opportunity for our Justice Department to intervene and establish a more consistent terrorist criminal system?
Am I just a wonkish ACLU type for expecting due process for one terrorist but not the Gitmo detainees? (If I believed that).
Will he be held in the USA until tried?
Will he be held as an enemy combatant?
If so, should he be sent to Gitmo?
Where should he be tried?
Does he have rights Gitmo detainees do not have? If so, why?
How is he different than other captured Al Qaeda operatives?
How would the Bush Administration have handled him?
Since he was arrested on US soil is he afforded our due process?
Admittedly, some of these questions are elementary for sharp legal minds but we are talking political advantage here. Will Fox News blow an intestine if this trial is held here?
Seriously, this really blurs the line between terrorists who commit acts here and those held in Gitmo. I look forward to the day better legal minds exploit this dichotomy for the benefit of the Holder decision to try 9/11 terrorists in New York City.
