Our man WineRev will be reporting in more detail, of course, but since he's in an airplane somewhere over Toledo right now, I thought I'd get the breaking news out...
...below the fold, of course.
According to Minnesota Public Radio:
Democrat Al Franken's attorneys called on the Minnesota Supreme Court today to uphold a ruling that declared Franken the winner of Minnesota's long-running U.S. Senate race.
Franken's lawyers filed their paperwork in response to Republican Norm Coleman's appeal.
Coleman has asked the court to order the three-judge panel that heard his election contest to count more rejected votes or say no one won the race. But Franken's attorneys say in most instances, Coleman either waived his rights to raise those arguments or simply failed to prove his case.
Franken's attorneys are also asking the supreme court to order the Minnesota Secretary of State and Gov. Pawlenty to sign an election certificate once the justices rule.
The governor has questioned when he must actually sign the certificate, particularly if the losing party files a case in federal court or appeals to the U.S. Supreme Court.
UPDATE: Here is the correct link to the respondents brief. I still stand by my comment that Lillehaug is spanking Team Coleman with the entire Duke Law School Library. :) And yes (h/t to TerribleTom), Elias too. Although he's probably wielding the Harvard Law School Library. Just for good measure. :)
I'll leave it to WineRev to do the analysis, and of course to ask the questions about whether we expect a response from Coleman, and what not responding/responding means from a legal standpoint.
But meanwhile, of course, follow the link below to buy the book if you haven't already.
PS: It appears there is no podcast of the interview with Eric Pusey on the Mark Heaney Show on Friday... I did listen, and it was great (thanks, Eric!).
