   This past week, there has been a national spread of a bad faith beating by Fullerton California police. Six (6) of them, beat a mentally ill - Harmless and Homeless man (Kelly Thomas) - where he died from the beating. An attempted cover up transpired and would have succeeded, had it not been for a father, a former Orange County Sheriff, who would not take $900,000 in hush money. For Ron Thomas, though estranged from his son, wants one thing to assure his civility - the Justice of Truth!

    Cast your eyes upon Egypt, Syria and now Great Britain. What you see are riots, rebellions and civil unrest against tyranny, cronyism and corruption. In Egypt, Syria and Libya, the citizens face greater brutalities for their civil unrest, as the powers that be decided to mame, beat and kill those who will simply not stand idle.

   In England, the purported land of civility where the cops (Bobbies) only have 17% who carry guns according to Wikipedia (here), riots have sprouted for 3 days. The riots in London are because of the shooting death of a youth by Police (see HuffPo story (here)). Yet, in our great land of civility, in America, we have no fear of such civil unrest, because we ARE a civil country, a land of law & order. But that backbone of civility is being put to the test in the brutal beating and death of Kelly Thomas. Last night, on several local television stations in the Los Angeles area (see CBS video (here)), Orange County District Attorney ( Tony Rackauckas ) stated that he reviewed the videotapes ( a vidoe that no one else but the Fullerton Cops have seen) - and has concluded there was no intent to murder. Obviously, OC DA Rackauckas has not been paying attention to the signs of the times. This obtuse grasp on reality, pushes the realms of Americans' civility to the test.


     Bare in mind, I am not one try or even desires to push for civil unrest. If you look at my history, how the federal system of justice has persistently broke the law to destroy me and helped organized criminals keep the keys to the vault they are fleecing (see websites (here) & (here)), you will find the story of abuse of power, tyranny, cronyism and corruption profuse. Yet I am still here, hoping to find the answer of a modern day - Diogenes/ Quest- and a civil servant more noble than former AG Ashcroft.

        However, I find myself in tears again today, crying for the weak, meek and mentally ill Kelly Thomas, whom the Fullerton bullies, the Fullerton Police (Fullerton 6) - did sensely beat in a manner that resulted in his demise.

  How can the Orange County District Attorney claim he is doing an honest job, when he keeps a friend of the Fullerton Police Chief on the case?
  What amount of unmitigated gall does one have as OCDA Rackauckas sits there with a purported straight face and says that the beating of this sweet face into a pulp like this - is NOT MURDER.

    Susan Kang Schroeder was the first Orange County District Attorney who went on the air and spoke about witnessing "The Tape". She stated that it was heart wrenching and gave her condolences to the Thomas family. DA Schroeder has posted this statement on the Orange County DA's website;

SANTA ANA – The Orange County District Attorney’s Office (OCDA) is seeking the public’s help identifying any witnesses to an incident involving a male citizen, 37-year-old Kelly Thomas, and officers from the Fullerton Police Department. The incident occurred at approximately 8:30 p.m. on July 5, 2011, at the Fullerton bus depot at 123 S. Pomona Avenue in the City of Fullerton.

Anyone with information or who believes they are a witness is asked to contact District Attorney Investigator Stan Berry at (714) 347-8813.

NO evidence Fullerton cops intended to kill

     Despite the vast details that are clearly evident by the small portion of videos that have been released to the public, the power centers are trying to diffuse or defuse (depending on your point of view) the case by allegations that Kelly Thomas was a schitzo and had belongings in his Back Pack that did not belong to him. This is utter Bull SHIT in the extreme. All homeless people ravage and are scavengers of those items we toss. What proof does the Fullerton Police have that those belongings are stolen?  NONE - it is a Cover UP attempt in the extreme.  

     Thus far, we can tell from the videos, that the persons who were there, were shocked and astonished at the brutality.


  Here is a Transcript of what was said by the witnesses on the BUS.

  Previously, we had a video from yesterday's Diary (here) - showing the same witnesses - at the scene - where their pictures were taken by a cell phone camera.

      That headline last night was by Los Angeles, CA. The reporter directly questioned the OCDA and asked him about the "good ole boys" network. The story (here) also reflects the wish of one Fullerton City Manager requesting the use of an "independent" investigator as stipulated in the Channel 5 story;

Fullerton's city manager told the Orange County Register he wants an independent consultant to conduct an internal investigation into police department procedures in the wake of Kelly Thomas' death and will ask the City Council to approve hiring Michael Gennaco to lead the probe.

Gennaco is a specialist in examining law enforcement agencies and chief attorney for the Los Angeles County Office of Independent Review, a civilian oversight committee that monitors the Los Angeles County Sheriff's Department.

Release of Video Forbidden by Orange County DA Rackauckas

     Purportedly, as per Orange County DA Tom Rackauckas, in order to protect the integrity of the investigation, the OCDA will not release any information regarding the investigation until it is completed. The media and public will be notified at that time and the investigative findings and legal conclusions will be available at

    Without any doubt, Ron Thomas is pissed today - as am I.  As is denoted on the many news stories out there last night, repeating over and over, Orange County DA Rackauckus was asked (specifically by a Channel 5 reporter) - about the "good ole boys" network classification his office is going to get, when it is well known that one of the DA's is a close personal friend of Fullerton Police Chief Sellers. The mere audacity to blatantly & flagrantly flaunt this serious Conflict of Interest openly, defies logic - instills civil unrest and is extensively heinous & egregious. Combine that with the public statement that this brutal and senseless beating is Not Murder - defies all common sense.

     Previously, in the 2 prior Daily Kos diaries by me on this issue, we had discovered through others assistance, that a person within the Fullerton Police inner circle had knowledge that the lead officer in this beating, actually bragged about it - when they arrived back to the station.

     What is now well known from the video, estranged or not, Kelly Thomas repeatedly called out the most important words to him when he was being beaten - of;

                                        "Dad - Dad - Dad"

     This has to be Heart wrenching for Ron Thomas, to hear the last words from your son and that they are cries of help, calling out for you - when you are incapable of coming to his aide at the time of his demise. I would rather be shot myself. It IS too much to bare.

     Regardless of the ultimate settlement that Fullerton Tax payers will have to pay and the final sentence of the Fullerton 6 Police involved in this senselessness, the fact of the matter remains - the Thomas family is still being abused. The Police Chief (Sellers) has not said he is sorry, the Conflict of Interest of the Orange County District Attorney Rackauckas stating publicly that it was not intentional murder and the withholding of the germane videos - all slap the face of the Thomas family scornfully. It is a rude, crued and inconsiderate attempt to diffuse/ defuse the case by utilizing time and repetitive verbal reinforced BS.

    Therefore, we have started a Petition for Ron Thomas to see the Videos.

       We ask the following questions of Orange County District Attorney Rackauckas


  1. If it were your child - would you then say it is Not Murder?
  2. Had Kelly Thomas beaten a Police this way - would you say it is not Murder?
  3. If a Police had beaten a DA this way - would you say it is not murder?
  4. Had a non white homeless beaten ANYone this way - would it be called murder?
  5. How can you be so stupid - as to let a friend of Chief Sellers investigate?
  6. Do you REALLY expect to be re-elected after the way you handle this case?
  7. Will you be surprised when your name is added to the RE-Call list?

    Had Laser Haas beaten up Osama Bin Laden this way - the DOJ would have called it murder. There has been no offer of apologies, no condolences formal, only an obtuse, callous and heartless City Attorney who told Ron Thomas his child is really not worth that much because

      "[Kelly Thomas] was no rocket scientist"

    It does not take a rocket scientist to see that this was a needless death. We either are a nation of civility by the rule of law

   It is might makes right!

   Civility's gateway is in the hands of our public servants of justice and they don't seem to really care - hoping for civil unrest - to justify their ways!  

   At the barest of minimums, Ron Thomas should get to see the video. After all, according to the whistle-blower from the KFI-AM 640 show (video above) - the Police altered their reports after they "Were Show the Video" of the Kelly Thomas beating.

  Hard to picture how that Obstruction and Destruction (the altered reports) - can be anything but harmful. The system has done its worse in the efforts of the Cover Up already. Time to find a new was to instill civility. Let Ron Thomas see the video, or you will only make things WORSE!

      see the video and then Altered their reports on the events.

      Damage has been done in the extreme. Ron Thomas is a veteran Orange County Sherrif. He has seen it all - already.

      Withholding the video and FACTS from him - only creates further public discord and lack of trust in our systems of justice.

      Unless the Police and authorities start to address this matter, another incident is likely to "take advantage" of these efforts to Cover UP and instill greater civil unrest.

        He should NOT see the video.  Use your heart, not your head.  He should NOT see the video.  That is how he will always remember his son: crying for Dad, being beaten.  The father's nightmares will never end.

        I don't care what he's seen in his job, it will Never COMPARE TO SEEING HIS OWN SON.

          In the interest of justice - to make sure (especially as a former Officer - who knows how "they" twist things for reports)

          to make sure he is getting "All" the facts.

          I have had 2 daughters abducted over a span of 4 years.

          As hard as it was - I wanted all the details, to make sure justice was served.....

          He saw the worst of what it did to his son in the hospital and has seen the cell phone video with the cries.

          There is NO way, on G-d's green earth, that he should NOT see the videos that the "Murderers" were able to see to "Alter" their reports..

          Though my kids have suffered much, through their ordeal, I was blessed to not lose them permanently. Especially when one was taken out of the country and the other was on a plane for the same path.

    at the hands of these officers.  Horribly.  Kelly screaming for his father will haunt me for a long time.  

    Society failed this man.  We failed to adequately address his mental illness, and we adequately failed to save him from brutality at the hands of people entrusted to protect us.

    We cannot fail him again when demanding justice for him and his family.  If his father wants to see the tape, let him.

    But I'd appreciate it if you would correct the misspellings and word usage errors. Great Britan, Eygpt, Lybia, mame, "Bare" vs "Bear", "diffuse" vs "defuse", etc.  It distracts from a passionate diary on an important subject.

    On the other hand, you did spell 'heinous' and 'egregious' correctly.  I doubt most people would even think of those words, much less spell them correctly.  :<)

    Good point about the riots in England. I hadn't even been paying attention to that, ignorantly lumping it in with the protests across Europe against the "austerity programs".
