First the city confirms there is no right to peaceably assemble in public spaces in Oakland.
Also that there is no public place for those that are homeless to go to to rest.

ATTENTION TO PERSONS LODGING IN ALL PARKS CITYWIDE
Date: November 13, 2011
NOTICE OF VIOLATIONS AND DEMAND TO CEASE VIOLATIONS
The City of Oakland and its Police Department support and protect the right of all individuals to engage in free speech and their right to assemble. However, this encampment is a violation of the law.
You do not have permission to lodge on or in ANY City property or parks, including and not limited to, Frank Ogawa Plaza, Lafayette Square Park, Jefferson Square, and Snow Park. You must remove all tents, sleeping bags, tarps, cooking facilities and equipment and any other lodging material from City parks and property immediately. Your continued use of City property or parks for lodging will subject you to arrest.
Your activities are injurious to health, obstruct the free use of property, interfering with comfortable enjoyment, and unlawfully obstruct the free passage or use of a public park or square. (California Penal Code sections 370 and 647(e) and Civil Code section 3479.) You must allow all persons, including Oakland Police officers and other emergency personnel, access to all areas at all times. Additionally, no person, other than a city employee in the performance of his or her duty, shall enter or remain in any park during the time when it is not open for public use. (Oakland Municipal Code 12.64.110)
You are making fires in a public park in violation of OMC 12.64.160. You must remove all barbecues and stoves.
YOUR CONTINUED VIOLATION OF THESE LAWS WILL SUBJECT YOU TO
ADMINISTRATIVE PENALTIES, CIVIL PENALTIES, CITATION, AND IMMEDIATE
ARREST.
YOUR CONTINUED VIOLATION OF THE LAW WILL SUBJECT YOUR TENTS, STOVES,
SLEEPING BAGS, TARPS, AND ANY OTHER BELONGINGS LEFT IN THE PLAZA OR
PARK TO IMMEDIATE REMOVAL BY THE CITY OF OAKLAND.
**Please see back of this notice for information regarding Homeless Shelter Services
that the City of Oakland is making available.
I bolded the admission that there are not enough beds for the homeless in Oakland. If there were, the telling of protesters to say they are from OO to get priority would not be necessary.
PLEASE be aware thar homeless people must leave the shelters every morning and return to hopefully get a place at night. By placing the homeless at OO in these shelters there will be people and families that are not involved with the protest denied beds!

AVAILABLE HOMELESS SHELTER SERVICES
The City of Oakland is offering homeless shelter services at two facility sites for those
who do not have an alternative place to go to. For individuals who do decide to go to one
of these shelters, please remember to alert staff at the Shelter that you are from
Occupy Oakland in order to receive priority.
Shelter for Women, Men, and Children:
Crossroads
7515 International Blvd
Oakland, CA 94621
• A shuttle will transport individuals at 2 p.m. today at 14th Street & Frank H. Ogawa
Plaza (14th Street side of Oakland City Hall)
Shelter for Men:
City Team Ministries
722 Washington Street
Oakland, CA 9607
• This shelter is on Washington Street, between 7th and 8th Streets, and is within
walking distance from Frank H. Ogawa Plaza.
Also do you see anything missing from that list above?
I do, Transgender people do not have access to shelters.
Transgender people make up a larger part of the population in Oakland than in many other places. Where are they to go?
I guess the city just assumes we will be out all night engaging in survival sex.
Another thing:
Families have pets. Pets are forbidden in shelters. Ergo to access the shelter you must part with family members and that is wrong.
