That's right, as many of you may know, I am a whistleblower. That vile, pathetic snitch, poor excuse of a human being most of you despise. Be that as it may, like it or not, you need us and we need you. Without each other's efforts - we ALL suffer more.
First, what is blowing the whistle? The terminology purportedly originates from the fact that a referee blows the whistle about a "foul play". Therefore, is it really being a snitch who is an informant that informs on fellow criminals? In my case, I blow the whistle to federal authorities because I refused to take a bribe. Private Manning was part of the army doing wrong, but he was not the one doing it - except that, arguendo, he did wrong by going outside of military channels. Goldman Sachs Greg Smith worked for the Occupy's enemy; but he quit because of their bad faith efforts. The sole difference between him, Private Manning and people like me - is the main stream media picked up the story.
Wikipedia defines whistleblowing (here) as;
A whistleblower (whistle-blower or whistle blower)[1] is a person who tells the public or someone in authority about alleged dishonest or illegal activities (misconduct) occurring in a government department, a public or private organization, or a company. The alleged misconduct may be classified in many ways; for example, a violation of a law, rule, regulation and/or a direct threat to public interest, such as fraud, health/safety violations, and corruption. Whistleblowers may make their allegations internally (for example, to other people within the accused organization) or externally (to regulators, law enforcement agencies, to the media or to groups concerned with the issues).
Whistleblowing is a necessary part of our lives. Though, most times, it tends not to solve the issue, due to cronyism and cover up - it does shed some light thereon. But, how do people in general feel about whistleblowers and is being a whistleblower a good thing? Does anyone really comprehend the fact that we, The People of the United States, are in need whistleblowers and that they (the tellers of truth), in turn, are in need of the people to not look down upon them?
Writing this Diary, at this time, is apropos in so many ways. I would argue with you that we are in the thrall. That we are upon the precipice of our darkest hour. There are our ongoing wars unjust, economics dire and civil unrest on a pathway to revolution. This is because, when it comes to whistleblowers - one's first basic inherent instinct is to scoff and dismiss. Or, instead of looking at the facts - because the subject is uncomfortable - we turn on high our deaf ears.
It is a fact that whistleblowers are dismissed - instead of praised. Such laxity in due diligences are the main reason why the harm continues to be emboldened and propogate against us all. Thus, like it or not, we are all responsible. It is not that whistleblowers want fame or fortune (don't we all). The main drive for pointing out wrongs - is to stop the wrong. It is not a matter of making a national spectacle - we are simply doing "our job".
This YouTube trailer to the movie "The WhistleBlower" sums up much of the complexity issues and anxiety. Please take note that the actess states;
"I don't want a scandal, I'm just doing my job' --
More importantly, the opening remarks about being hired as
"a beacon of hope -- to protect the Rule of Law --"
Being a whistleblower is about what is right. So why are those who seek to help us get to the Truth looked down upon as wrong?
Penalties for being a Whistleblower
What riled me yesterday, was close friend telling me to drop all my current efforts and go seek to get paid. That the Dodd Frank Act, SEC and IRS would love me and I could make money from them with my research, connections and detailed understanding of the issues. He pointed out the recent cases of those who just got paid millions for assisting us all to receive the $26B bailout from the banks on the mortgage crisis. Or, I can go to Newt/ Santorum's camps and sell my story. That my my sole pursuit should be to make money. If not, he said - you are suffering for nothing.
Is it truly nothing? When you point out federal corruption assisting Goldman Sachs, Bain and a POTUS hopeful - are the penalties you pay due to your efforts - enough to assauge you from the pursuits? If that was what my efforts were all about. Making money. I would have taken the $800,000 bribe 10 years ago.
He and many of my friends believe I am an idiot for turning down the money. Including a former partner who told me he could have spoken to them and re-worded the dealings - to my comfort. When I did not, my partner (who was retired) - locked me out of my stores and stole from me too.
SSSSHHHHEEEESSSSHHHHHH
Doesn't anyone get it. Losing money for telling the truth about harm to others, is a consideration of outcome - but should never be a deterrent to disclosure (truth telling). Yet, that is what transpires. When you blow the whistle - for what ever the reason - you WILL, more often than not - pay penalties.
There are seven untimely deaths in our related cases. Five are (purported) suicides, 1 a murder and another was a co combatant with me -who had to shoot and kill an assaulting party in his home. (Why won't you damn whistleblowers just go away)? The bigger the case, the more determined the parties are to shut down the truth telling.
Yesterday, Bloomberg came out with a story germane. The article (here) is entitled "Whistleblower Gets Sham Justice From Wall Street Court". It is about the case of a Morgan Stanley financial advsior (Mark Mensack) who noticed a "pay-to-play scheme" in the $ billion 401(k) assets handled by Morgan Stanley. He played by the rules and went through the chain of command and was ostracized. As Bloomberg denotes that even a former SEC assisted in sweeping it under the rug;
the head of the firm’s 401(k) department threatened him in an e-mail for pursuing these alleged violations. When the matter reached Gary Lynch, the firm’s general counsel at the time and a former chief enforcement officer at the Securities Exchange Commission, his response was “reasonable minds can differ,” Mensack wrote me in an e-mail. The response from a different executive was, “There is no bright line rule addressing this issue.”
Retaliation included Morgan Stanley suing Mensack (and winning) $750,000
After he reported the wrongdoing, Mensack claims, Morgan Stanley “began retaliating against me such that it was impossible for me and my team to conduct ethical and legal 401(k) business” -- in effect, a constructive dismissal.
Then, the Bloomberg story denotes that Mark Mensack was pushed to go to the Financial Regulatory Authority (
FINRA); which boast on its website it exists as "Investor Protection" and for "Market Integrity". Bloomberg reporter Tobin Harshaw (email tharshaw@bloomberg.net) also points out the fact that this is most likely BS - because FINRA gets $1 Billion in funding from the very institutions it "
purportedly" regulates.
DEATH of a Whistle Blower
In Nevada, 2 whistleblowers came forward and disclosed that companies were intentionally breaking the law and ordering their workers to do the same, pertaining to the mortgage crisis (in this case LPS). One whislteblower, Tracy Lawrence - is now DEAD. AS reported upon in the Huffington Post story (here) and MSNBC (here);
HuffPo
Tracy Lawrence, the notary public who blew the whistle on a massive foreclosure fraud scheme, was found dead in her Las Vegas home on Nov. 28, MSNBC reported.
MSNBC
Lawrence came forward earlier this month and blew the whistle on the operation, in which title officers Gary Trafford, 49, of Irvine, Calif., and Geraldine Sheppard, 62, of Santa Ana, Calif. — who worked for a Florida processing company used by most major banks to process repossessions — allegedly forged signatures on tens of thousands of default notices from 2005 to 2008.
Trafford and Sheppard were charged two weeks ago with 606 counts of offering false instruments for recording, false certification on certain instruments and notarization of the signature of a person not in the presence of a notary public.
Tracy is gone and chances are we will never see the real reasons why.
Goldman Sach Exec Blows the Whistle on Bad Ethics at Sachs
Greg Smith, an Executive at Goldman Sachs, submitted an Op-Ed to the New York Times that was published. It is entitled "Why I am Leaving Goldman Sachs". Where Greg Smith said;
TODAY is my last day at Goldman Sachs. After almost 12 years at the firm — first as a summer intern while at Stanford, then in New York for 10 years, and now in London — I believe I have worked here long enough to understand the trajectory of its culture, its people and its identity. And I can honestly say that the environment now is as toxic and destructive as I have ever seen it.
Then he basically blew the whistle on Goldman Sachs. Greg Smith denotes that integrity is the exception, instead of the norm and that the goal is how much money can Goldman Sachs make of its clients - instead of for them. He stated;
When the history books are written about Goldman Sachs, they may reflect that the current chief executive officer, Lloyd C. Blankfein, and the president, Gary D. Cohn, lost hold of the firm’s culture on their watch. I truly believe that this decline in the firm’s moral fiber represents the single most serious threat to its long-run survival.
and Then Greg Smith gives an ominous prediction of demise
I hope this can be a wake-up call to the board of directors. Make the client the focal point of your business again. Without clients you will not make money. In fact, you will not exist. Weed out the morally bankrupt people, no matter how much money they make for the firm. And get the culture right again, so people want to work here for the right reasons. People who care only about making money will not sustain this firm — or the trust of its clients — for very much longer.
Going to the Department of Justice is Foolishness
As noted in Greg Smith's OpEd, he says he does not know of any actual acts of illegal dealings. That must be because he did not look too hard for them. We have been screaming at the Department of [IN]Justice for a decade. About federal, SEC and state frauds by Goldman Sachs, Bain and their law firms. Even when we have confessions - there's no investigation or prosecution. All you need do is Google Laser Haas and Goldman Sachs or Bain or eToys. But, the fact of the matter is, everyone gives up on trying to tell the story. The only tool to rectify the mess is the Department of Justice and they ain't in the prosecution of Goldman Sachs/ Bain business (for some inexplicable reason).
Take the fact that we all are now publicly informed that the Department of Justice has a history of bad faith acts. Madoff and Petters got away with it for a decade, not because the federal agencies weren't informed about the crimes - but because they didnot desire to address them. On the right is a public domain picture of the Department of Justice's Office of Special Counsel (OSC) - a place where federal employees can go to Blow the Whistle. Yet, in 2008, the head of that agency had his office raided by the FBI - for Destroying case files (see Wikipedia (here)). We can NOT say for sure that Scott Bloch destroyed our file. But it is still not being investigated. Scott Bloch betrayed his oath to the American people. A GREAT EVIL. Yet, even when he plead guilty - he refused to do 1 month in jail.
It is a also a fact that the Securities and Exchange Commission (SEC) has confessed to destroying case files. The New York Times reported (here) that:
WASHINGTON — An enforcement lawyer at the Securities and Exchange Commission says that the agency illegally destroyed files and documents related to thousands of early-stage investigations over the last 20 years, according to information released Wednesday by Congressional investigators.
The destroyed files comprise records of at least 9,000 preliminary inquiries into matters involving notorious individuals like Bernard L. Madoff, as well as several major Wall Street firms that later were the subject of scrutiny after the 2008 financial crisis, including Goldman Sachs, Lehman Brothers, Citigroup and Bank of America.
Dept of Justice Threatens Career Asst US Attorneys
It is also noteworthy to denote that the mendacity was not there only as well. When we presented the evidence to the Department of Justice Public Corruption Task Force - that a United States Attorney betrayed his oath of office and refused to investigate and prosecute federal corruption. He (SoCal Los Angeles US Attorney Tom O'Brien) simply walked into a weekly staff meeting - yelled at career Assistant United States Attorneys and actually Threatened them (reportedly) to keep their mouths shut as to the reason why. (See Los Angeles Times story "Shake-up roils federal prosecutors" that states verbatim;
O'Brien said -
Eliminating the public integrity and environmental crimes section, spokesman Thom Mrozek said, would actually enhance the effort to prosecute such cases.
The Threat
They said O'Brien also threatened to tarnish their reputations if they challenged the official explanation for the unit's dismantling in conversations with reporters. Members of the unit contacted by The Times either spoke on the condition that they not be named or declined to comment. Several said they wanted to talk about the situation but feared reprisals if they did so.
Now, can anyone really say enough about that. A United States Attorney SHUTS DOWN the Public Corruption Task Force - AFTER - they were informed about a US Attorney that was a partner in a Goldman Sachs law firm (www.MNAT.com) who refused to investigate and prosecute Goldman Sachs. It was only in the LA Times - but should have been a nationally reported story.
As for the current mortgage crisis. It is noteworthy to point out that we can expect similar results. I gave the evidence to AG Holder, the OPR, SEC and everyone else - AGAIN - once Obama was in office. Still NO Investigation. Same thing with the mortgage crisis. MERS and the banks are doing fraud every day. Violating the Law, stealing revenue from states to benefit banks. The same banks that got a $700 billion dollar bailout from us that is giving us $26B back. Whoop'dee Friggin DO....
But, you cannot expect them to face culpabilty - they are Criminals Too Big to Fail. Plus, they have friends. Lanny Breuer, the head of the Department of Justice Criminal/Fraud Division and Eric Holder and ARE required by federal conflict of interest rules to recuse themselves from the case - BECAUSE - they were at Covington & Burling - the very firm that helped Freddie Mac and Fannie Mae create MERS. If you are not aware, they feds had to seize them. MERS claims to own half of all mortgages. (See Reuters story "Top Justice Officials connected to mortgage banks" (here).
CONCLUSION
It is axiomatic that our country needs whistleblowers. Living without them fosters manifest injustice extensive. However, it is also true that whistleblowers truth telling is in vain - if the people and press do not applaud and assist. You have writing to you this very moment, a case in point proof.
For a decade now, we have been documenting crimes, perjury, mayhem and more directly linked to Goldman Sachs/ Bain and their organized criminal law firms. We even have confessions and ALL the other proof is public docket records overwhelming, irrefutable and profuse. A blind man can literally prosecute these cases and get a conviction.
However, due to some pathetic human weakness, because we are direclty talking. Most would rather push my face in the mud, instead of demanding this evidence be address. That is PATHTETIC. It is even hurting us right now. Mitt Romney benefited from the fraud and continues to benefit. If all this evidence was pointed out, his hope for election as POTUS would end TODAY. Instead, Romney's camp is encouraged to do more crimes. They are power rigging the votes/ wins in an election.
You need me - whether you like me or not.
AND I need you to help to spread the word
Their crimes are as plain as the nose on your face.
They are beating up Occupy parties and bankrupting our country to Bail out these evil masters and will continue to do so. Unless WE do something about it. I lost my career, life savings, had a kid kidnapped and know of people dead that talked to me. Because silence of the Truth is what the bad faith parties need.
You can stop the bad faith from spreading by helping a whistleblower
Instead of Hating them!
It is real simple.
Things are on Fire all around you. But you don't want to hear me tell you that mayhem and mendacity is transpiring.
It is NOT, as you say, Your problem and you don't want to hear of it.
Because you are the genius who has the solution - that your house is safe - because mine is on fire south of you - but your house is safe - You Don't Care.
your are also saying that to the neighbor north of you, east and west - you have even suggested to your wife that she should go get marshmallows and a beer. You can have a party dancing on our graves.
Good For You -
GENIUS!
