Charging scandal-plagued eleven-term congressman Jim Moran with corruption, Bruce Shuttleworth accused the Moran machine of organizing “Petitiongate,”a clumsy Keystone Cops attempt to prevent Moran's challenger’s name from appearing on the primary ballot this June.

Although Bruce Shuttleworth did not name him by name, the Chair of the Virginia Democratic Party who certified Jim Moran as the sole candidate eligible for the June ballot is Brian Moran, the brother of Congressman Jim Moran.

The following statement is from the website of Bruce Shuttleworth, Candidate for Congress, VA-8.

Good afternoon Ladies and Gentlemen!

Many thanks to all my supporters, especially my family, who are here today on short notice.

I have some prepared remarks related to our recently filed lawsuit in Federal District Court: Shuttleworth v Moran.

After hundreds of hours by dozens of supporters who meticulously gathered petition signatures, on March 29th, my campaign carefully placed them into 4 sealed envelopes and hand-delivered them to the Chairperson of Virginia’s 8th Congressional District Democratic Committee, Ms. Margo Horner.

On April 2nd, 15 minutes before close of business, I was alerted, by voicemail, that our 1,823 signatures somehow could not even yield the 1,000 required; and that the Chairperson was in the immediate process of certifying my opponent – who, by the way, received $5,000 from the very Committee who was solely responsible to administer a fair count.

Truth be told, I haven’t checked this morning, but as of yet, our campaign has not received a similar contribution. But we remain optimistic – hope springs eternal. But I never did formally ask. So Ms. Horner, how about it? In the interest of fair play, may we have a campaign contribution too?

Let me assure you that feeling powerless under the boot of party hacks is not my style. I didn’t spend 8 years as a Naval Officer to be bullied about by Moran’s Minions – and neither should you.

So we demanded to see our petitions. After days of delay, we finally got them, and folks, it was as if our petitions, the will of the people, had entered the Land of Oz – where you are not expected to look behind the curtain. In went 168 sheets; and out came, wait for it, 107.

Friends, our democracy is not a clothes dryer; where critical petitions can just be “lost” – like so many socks. So we called her to say “excuse us, but how can dozens of our petition sheets have gone MIA?” – and we heard nothing but crickets!Now having no confidence in a Chairperson who would not even return our calls, I decided that our only course of action was in the court of law.

And that requires a lot of work as well as a lot of money – money that if the Democratic machine has any decency they will repay. Now I’m not sure what you did on Easter Weekend; but my wife and I spent 50 plus hours tracking down registered voters who were told that their voice didn’t count. And here they are. And boy, some of them are really angry with Moran and his Machine.

I take no pleasure in having to resort to legal action with my Democratic Party, the greatest Party in the land. The Party of social and economic justice, of equality and fairness for all. They have no right to do this to our Democratic Party.

But when those very ideals have been sacrificed at the alter of political greed, where the instinct to stay in power overwhelms any instinct of American fair play, then I say that it is time to clean house – and with your help, we have the brooms to do it.

So, somewhat less than miraculously, when confronted with a lawsuit, suddenly those hard-to-find missing petitions magically showed up – and now we have the required number to be on the ever-elusive ballot.

I wonder where they could have been – mystery-of-the-ages. The people’s will must not have been too important to them. But it is important to me.

And I have a question: After more than a quarter century of Moran at the helm of this party machine, when petitions for getting on the ballot for the United States Congress can for one second, one second, be “misplaced”…what kind of Banana Republic is he trying to turn Northern Virginia into?

This Ladies and Gentlemen is Petition-gate and I think this is worse than subjective hanging chad determinations. How can this happen in America? Who will be held accountable?

You know, I would like to make a formal complaint about the petition certification process, but unfortunately…we haven’t been able to detect one. There is no due process, there is no right of review, there are no receipts, there is simply trust us, hand them in and trust us – even though its been made very clear that challenges to the throne are not welcome.

Thus, there has been a grotesque miscarriage of justice and we will perhaps never know how deep it goes. If the full truth in this case is ever revealed, I think the voters will be very interested to find out what goes on behind the curtain.

Make no mistake, in this instance, some of Moran’s supporters cheated the people. Without the recourse of legal action, I would not have made it onto this ballot and your voice would not have been heard. I think this sordid episode makes it clear that the incumbent and some of his supporters will resort to nearly anything to deny a meaningful choice.

What kind of pathetic smoke-filled back room Tammany Hall corruption is going on around here?

I say no more rolling over to the forces of corruption and incompetence. It is time to Roll With Honor.

I entered this race for all the right reasons: #1 on the list was fighting corruption. And here we are. It is exactly this kind of anti-democratic nonsense that encouraged me to run in the first place.

I am running for Congress because America is in a fight that must be won.
And that battle, quite simply, will be fought over whether we become a nation led by honorable leaders – or not. Choose wisely and America will lead; vote otherwise and America will follow. Dishonor and decay go hand in hand.

And you know what, I’ve had enough. I’ve had enough of these excuses. Our Nation has had enough of this mediocrity from our so-called leaders who fight for themselves with their palms open instead of fighting for the people with their fists closed.

We need to take back our country. We need to take back our Party. Let me be clear, you will have a choice on June 12th to send an honest man to Congress.

This is a battle for the honest leadership of America – and it will now be fought in the ballot box, where it belongs.

        At 157 out of 200 Democrats, Moran's progressive rating is terrible.  The man is one of Congress's leading defense industry shills.  Moran wrote the Moran-Bush Bankruptcy Act to disempower consumers and to give banks more tools to torture their customers.  Moran is for big-bulging defense budgets to satisfy the massive companies in his district.  Moran has been hauled before the Ethics Committee twice for conflicts of interest.  Tim Kaine led the charge against Moran over sweetheart loans from banks and his pro-banking legislation.  The STOCK Act was written with Moran in the cross-hairs since he has been dealing in insider-trading for the past 22 years.

    An incumbent state rep here in Philadelphia turned in 1,854 signatures, needing 300 good ones to be on the ballot this year.

    He didn't have 300 good ones.

          and as for petitions "ending up in the trash", that's a complete lie. The signatures were divided up and sent to the 4 jurisdictions where they were collected; Arlington, Alexandria, Falls Church, and Fairfax County to be verified by their respective clerks. The clerk in Arlington noted that a number of Fairfax County signatures were erroneously included in her pile and she notified the appropriate individuals of the problem. The problem was quickly corrected and Fairfax County validated the signatures.

          What's more important, IMO, is getting a clear understanding of Shuttleworth's support from SuperPAC, Campaign for Primary Responsibility, funded by big Texas oil money and Erik Cantor.

        Extraordinary claims require extraordinary evidence.

        Furthermore, any responsible campaign does two things -

        1) Verifies signatures themselves against voter rolls to be sure you have enough valid signatures, and ...

        2) Make copies of all your petitions before you submit them to avert any potential fraud like the type you've claimed.

        Finally, VA-08 - A half dozen people can probably collect 1800 signatures standing on King Street in Old Town Alexandria on a Saturday afternoon, or one person standing at the entrance of each of the Orange Line Metro stops on a commuter morning. This signature collection effort in a such a densely populated area seems lame at best.

        Finally, I asked you in your prior diary to elaborate on the relationship between Shuttleworth and SuperPac Campaign for Primary Responsibility, Leo Linbeck III, and Eric Cantor. You seemed to have ignored that.

          The petitions were valid, but the Moran Machine lost them and told Shuttleworth he failed.  Shuttleworth filed a lawsuit in federal court and the petitions were immediately discovered.  Petitiongate is proven by the facts.  The political corruption surrounding the Morans and the Moran Machine aka the Moran Mafia is now publicly acknowledged.  Moran is unfit to serve in Congress.  How dare you defend him!

              You cannot make any demands of me - the burden lies on you to prove your wild allegations.  Shuttleworth says on his video that he still does not know where the petitions are.  Nobody has produced them yet because they are part of a federal lawsuit.  What rubbish about Shuttleworth and the Superpac - a despicable outfit that targeted Moran because he is obviously vulnerable - just like the targeted a Marcy Kaptur.  Moran is the villain, and his Moran Mafia.  They rig ballots, while Moran attacks 8-year old black children and shouts the (N-word!) at the top of his lungs.  Moran beats his wife and you and your ilk cover it up by saying he is a fake progressive rated at only 157th in Congress!  How dare you support the Biggest Crook in Congress!

                My defense, is a defense of the truth. The wild allegation is yours, not mine. You make a claim, you have to provide the evidence. The onus is not on me to prove that your lie is indeed a lie, although I did when I posted the link with the facts as to what happened with the petitions.

                  Bruce Shuttleworth published the evidence that refutes your supine acceptance of an alibi.  Shuttleworth filed his lawsuit in federal court.  A video of Shuttleworth's statement transcribed above is available on his website linked above.  The burden of proof lies with anyone contesting Shuttleworth's case, and a simple citation to the self-serving and unsworn statement of Coy is no proof of anything at all.  You are making wild and inflammatory charges in comments that are uncalled for given the overbearing weight of the evidence in the case of Shuttleworth v. Moran, as it is known in court.

                    As far as I can tell, Shuttleworth is a credible, reputable candidate. I've got no dog in this hunt. I am not tied to Moran, nor am I a supporter of his. If you're trying to convince 8th CD voters (me) that Moran is a turd and Shuttleworth is a better candidate, you're doing a shitty job of it.

                    Apparently, you haven't participated on this blog much. I've been here for 9 years. Extraordinary claims require extraordinary evidence. You've failed in that department. And, personal attacks are unacceptable here and tantamount to trolling.

                      For starters:  Moran, his brother and their apparatchik, Margo Horner, and others named in Shuttleworth v. Moran were at fault when they attempted to block Shuttleworth by rigging the primary ballot.  Your rude and profane verbal assault on me does not deserve a polite response.  Apparently, you do not know the meaning of an 'ad hominem' attack.  When something is "lost" in any bureaucracy, it is tantamount to being "trashed" - and to date, Shuttleworth has not been given his petitions that were erroneously, incorrectly and unprofessionally miscounted and then lost - as he explains in the video linked above.  It is clear that you have neither watched the video nor read the statement of Bruce Shuttleworth.  Had you done so, you would have deduced that Bruce Shuttleworth has provided all the evidence the court will need in his public statement as well as in his lawsuit to assert his complaint about the corruption of Jim Moran.  As for your recommendation to 'clean up your act,' you should contemplate following your own advice.

          ...can follow instructions and collect petition signatures...
          And submit more than the required signatures so they don't have to BUY THEIR WAY onto the ballot.

          Anyone working in business, military or just plain common sense person knows that you document and keep copies of important paperwork including petition cards.

          Anyone candidate that is campaigning has a voter file and knows how to use it.

          That is why this election system is so screwed...this is nepotism as best, the candidate who got certified was the one who is the Dem Party's Chair's brother...things that make ya go hummmmmm...

          And lo and behold, as soon as it is revealed that there is a Fed lawsuit...some of the missing petition signatures show up in someone's stack somewhere else...how CONVENIENT as the Church Lady used to say!

          Most voters do not even know what the petition cards are for...they think if they sign them, that obligates them to vote for that person...places to get valid signatures are more and more restricted all the time. Forget a public sidewalk or in front of a government building for the most part. Or even a post office. The person gathering signatures will usually be asked to leave.

          If it was an easy thing to do, more people would be doing it and there would be less money spent getting on the ballot (and then being BOUGHT and under corporate control).

    It's hard to believe a solidly progressive, 10-term Congressman is really sweating a primary challenge to the point of engaging in election fraud. Also, the petitions were certified by the 8th Distrct Democratic Committe, so Moran's brother wouldn't have been involved. Finally, there's a innocent explanation for why so many signatures didn't qualify-- the Shuttleworth campaign doesn't really know what they're doing. For example, the campaign manager was collecting signatures (who lives in Maryland) was collecting signatures even though canvassers had to be eligible voters, which resulted in a lot of them being tossed.

      Moran is a fake progressive masquerading as a champion of human rights while taking bribes from banks in the form of sweetheart loans - then writing their legislation to give them tools to torture their customers - the Moran-Bush Bankruptcy Act.  Moran takes care of the defense contractors as well, and he is one of the biggest earmarkers in Congress.  Moran throttled an 8-year old black boy and the racial profiling incident was covered by NBC Today.  Moran is a menace to the American people and a disgrace to the voters in VA-8.

      I think you will find that there is no law.

      I have collected plenty of ballot signatures for candidates everywhere.

      At no time did I have to provide my personal information or contact info or voter's ID...
