Online newspapers are buzzing with headlines:
CNN: "High Court Appears to Lean toward Arizona in Immigration Law Dispute"
LaTimes: "Supreme Court may uphold part of Arizona immigration law"
The part of the AZ Immigration Law the Justices seem to be siding with is the racial profiling, fascist "Papers Please" part.
So how about every cop out there pull over Justice Alito, Thomas, Roberts & Scalia for faulty tail lights and say "You dudes look like immigrants, I want to see your 'Papers Please.'"
President Obama's Administration won lower court rulings that blocked Arizona's law on the grounds that it conflicted with the federal government's control over immigration - DUH!
Chief Justice John G. Roberts Jr. said he saw no problem with Arizona's police checking with federal immigration officials once someone has been lawfully stopped. Roberts never did give a damn how past Courts have ruled on issues and he sure as hell doesn't give a damn now. "Lawfully stopped" as in gee dude, your tail light looked like it was out to me ... Papers Please.
Prior Supreme Court has ruled that the Congressional power to regulate naturalization, from US Constitution Article 1, Section 8, includes the Federal power to regulate immigration (see, for example, Hampton v. Mow Sun Wong, 426 U.S. 88 [1976]).
Allow me to translate that for Roberts: Only the Federal Government could write legislation allowing local police departments to detain people asking for "Papers Please" as States do not have that right under the Constitution.
The LA Times Reports that today in Court -
Government's Lawyer Verrilli repeatedly said the Federal power over immigration was "exclusive" and did not allow any role for the states and police.
But the chief justice [Roberts] said the decision on whether to detain or deport an illegal immigrant still would rest with the federal government, not Arizona. "It's still your decision," he told Verrilli. "It seems to me the federal government just doesn't want to know who is here illegally."
Does Roberts even believe his own bullsh&t? He said, "

Legal Definition: Detain: The act of retaining a person or property, and preventing the removal of such person or property. As in, being "detained" by Arizona PD while they call the Feds to see if the person they are "detaining" is in the country legally.
Maybe Roberts has lost his mind and forgot what the legal term for "detain" means? Or, maybe Roberts is just a crappy Justice who presides over the worst Supreme Court in the history of America.
And what about Roberts' line,
ROBERTS: "It seems to me the federal government just doesn't want to know who is here illegally."
WTF! Even if that
is his opinion should Roberts be legislating
his opinion from the Bench?
Early in the Hearing, Roberts told the Government lawyer that the Court would consider only concerns over state-versus-federal power, not civil rights issues that are the subject of other lawsuits. Therefore, Verrilli was shut-out from arguing that the "stop-and-arrest" provision, if put into effect, would lead to the harassment and intimidation of Latinos.
The LA Times reported:
While Clement, a solicitor general under President George W. Bush, made his argument with few interruptions, Verrilli was stopped repeatedly by justices, just as he was last month during oral arguments over Obama's healthcare law.
What dicks! Bush v. Gore, Citizens United ... Who in their right mind even respects the Roberts' Court?
Ah ... but one of the biggest dicks of all was Justice Scalia.
When the solicitor general said the "aggressive enforcement" of immigration laws could offend Mexico, Justice Antonin Scalia objected. "Look, free them from the jails and send them back to the countries that are objecting. What's the problem with that?"
So ... Roberts says,
"It seems to me the federal government just doesn't want to know who is here illegally."
And ... Scalia says,
"Look, free them from the jails and send them back to the countries that are objecting. What's the problem with that?"
Damn, Scalia just came shy of saying, in his perverse, red-neck tone: "
Round up all them there immigrants and and ship em out"
There is no doubt that Scalia & Roberts will legislate from the bench because they are corrupt b@stards, full of hate and would love to see Fascism take over America.
If the Supreme Court does uphold Arizona's Papers Please law, it would be one more ruling that will make the Roberts Court go down in history as being the absolute worst Supreme Court in the History of America.
The bright side? If there is one ... if the Supreme Court upholds the Papers Please law, that Mitt Romney is already on record as supporting, then hopefully not a single European Immigrant, Asian Immigrant, South American Immigrant or any other immigrant will vote for any GOP in November.
