Tonight, expecting the Texas execution of Anthony Bartee to go ahead as scheduled. Thus, I took the chicken's way out and laid down for a nap. To the chagrin of my presumption of facts not in evidence, I awoke to find this unexpected, good news headline by the Associated Press;
Last-minute reprieve stands for now for Texas
man set to be executed in neighbor's Killing
It is denoted by the AP (in the
Washington Post reprint) - that the federal appeals court refused to overturn a reprieve of a District Court. This, despite the fact that the United States Supreme Court had already rejected other Bartee's appeals.
Yesterday I had written a "belated" Diary on the scheduled execution of Anthony Bartee entitled "Set for Execution Wed - Texas has 5 Executions Scheduled Soon". I had to apologize due to the fact that I was tempted (ashamed so) - not to report the on this particular case that I had not been involved in. Due, in part, to what appears as obvious Anthony Bartee guilt. --- Now, I have "slight" doubts. --- But that does not change the fact that we should always fight to Abolish the Death Penalty.
As denoted in the previous Diary, it is reported that Anthony Bartee sought to hire hit man to kill a "white-man" named David on the eve of the day before David Cook was murdered by a stab in the back, slice of his throat and gun shots.
After the killing, Anthony Bartee was noted as riding around on David Cook's motorcycle claiming it as his own. All of such seems really lacking in any reasonable amount of good sense and standard brain functions. Especially for a man previously convicted of aggravated rape.
However, Anthony Bartee claims that David Cook was killed by 2 "Bikers". It was known that Bartee and Cook were next door neighbors, hung out together, frank beer together and smoked pot together. The 2 purported bikers were never found.
Bartee's case is that there is DNA evidence availabe from smoke butts and other such items found at the scene of the crime. Anthony Bartee claims they can provide proof someone else was at the scene. Not likely - but possible. Thus the stay on appeal till the issues can be worked out. It may take 2 months.

This is great cause for alarm, considering that WE are the Progressives, the Liberals, the Democrats who fight, speak out and stand tall against the Right makes Might state of being.
