On 2/12/13 at
approximately 11:49 pm, BPD was dispatched to the 2000 block of Allston
Way on a disturbance call. Upon arrival, uniformed officers spoke with the reporting party and were directed to the 41 year old male subject’s residence nearby.
During the contact, the subject became increasingly agitated and
uncooperative to the officer’s verbal commands and began to scream and
violently resist. After struggling with officers they were able to gain control
of the subject and place him in restraints. The subject continued to kick and
scream at officers.
Due to the subject’s large stature, officers requested the assistance of the
Berkeley Fire Department for a gurney to assist in transporting the subject
for further evaluation. While under restraint officers determined the subject
was not breathing and immediately began CPR.
BFD arrived and transported the subject to a local hospital where he was
pronounced deceased.
Per BPD policy, the District Attorney’s Office was notified and the case is
being investigated by the Detective Division.

When you write a report you are taught to explain in detail exactly what happened. How did she violently resist? What did she specifically do to initiate a lethal response from the police?
IMO from reading the vagueness of that statement any violence she did was a response to pain stimuli initiated by the officers. If she did do something it would be clearly stated ie: she swung a closed fist at the officer.
So they waited for the ambulance to arrive and placed her on a gurney before checking her vitals. How brave.
During the meeting’s public comment section, community members urged the commission to find out details about the night, when a 41-year-old transgender person who was initially identified by police as Xavier Christopher Moore, died. The community members also inquired about the status of the coroner’s report.
When asked by Commission Chair Kiran Shenoy about whether the coroner’s report would be released, Berkeley Police Department Captain Cynthia Harris responded that the department was still waiting on it and that there were not any new developments regarding the investigation.
I'm sure when the Berkeley police department is done investigating themselves we will find that this woman died of natural causes.
Because lets face it if you are Transgender being murdered by a mob of angry people is not outside the realm of natural causes.
