It's Memorial Day, and we begin with some good news for Native vets and their loved ones.
Last Thursday, Senator Brian Schatz (D-HI) introduced new legislation, S. 1046, that would finally provide for a Native American veterans' memorial on the Washington Mall. It's a project that has ostensibly been in the works since 1994, when the original legislation was proposed jointly by Schatz's predecessor, the late Senator Daniel Inouye, and Senator John McCain (R-AZ). But as so often happens with such proposals, strings were attached that, absent a revised bill, made implementation impossible.
The original legislation made the National Museum of the American Indian [NMAI], a part of the Smithsonian system, responsible for construction of the memorial. It also required the NMAI to use only private funds; it allocated no government monies for the memorial. However, the NMAI was also forbidden from raising those funds itself. When the entity charged with responsibility for a memorial is barred from the most basic fundraising for the project, it's no wonder that, nineteen years later, the entire project had fallen by the wayside. Schatz's legislation will remedy the problem: It removes the fundraising responsibility from the NMAI entirely, handing that task over to the Smithsonian Institution, which is equipped both legally and practically to handle it. [And in a glaring bit of irony, as of this writing, I am unable to link to the NMAI Web site properly because its pages all return a technical error. The Smithsonian host site, however, remains up.]
Currently, not one of the war memorials on the Mall includes American Indians. Indeed, it's a perfect example of how invisible Indians are to the country as a whole: The Viet Nam Veterans Memorial includes the so-called "Three Servicemen Statue," meant to depict white, African American, and Latino members of the armed services. Native American soldiers weren't even part of the thought process — despite the fact that they serve at a higher per capita rate than any other ethnic group in the country, as Schatz's accompanying press release noted:
"Per capita[,] Native Americans, including American Indians, Alaska Natives and Native Hawaiians, serve at a higher rate in the Armed Forces that [sic] any other group of Americans and have served in all of the Nation's wars since the Revolutionary War. Our Native veterans have sacrificed their lives for this country and it is important that we recognize their bravery and patriotism with a fitting memorial."
In praising the new bill, Jefferson Keel, president of the
National Congress of American Indians, was even more direct:
"Most importantly, this bill allows for more flexibility for tribal nations and the United States to work together to honor the contributions and sacrifices of American Indian, Alaska Native, and Native Hawaiian military service members and veterans. As a Native veteran myself, I look forward to the day my fellow veterans are recognized for their contributions to protecting the sovereignty of tribal nations and the United States."
Exactly.

INTERNATIONAL: RÍOS MONTT GENOCIDE CONVICTION
THROWN OUT BY HIGHER COURT
Speaking of war, we have an update on the recent genocide conviction of war criminal José Efraín Ríos Montt. The conviction — surprise! — has been thrown out.
When I wrote about the surprising trial and conviction two weeks ago, here, I noted how unlikely such a proceeding was. I also noted that "Guatemalan conservatives [were] already issuing dire warnings that the verdict may 'embolden' other indigenous populations to seek legal redress." So the fact that the convicted war criminal, who orchestrated a campaign of genocide against Guatemala's indigenous Maya Ixil population in the early 1980s, spent only two nights in prison doesn't exactly come as a shock.
The grounds are supposedly procedural:
However, in a ruling on Monday, the country's Constitutional Court ordered that all the proceedings be voided going back to April 19, when one of the presiding judges suspended the trial because of a dispute with another judge over who should hear it.
It was unclear when the trial might restart.
My guess is that the short answer to that last question is "Never."
Reuters is reporting that the decision is based on a series of courtroom disputes involving the demand by one of Ríos Montt's attorneys that two members of the three-judge panel recuse themselves:
At the time the row broke out between the judges, a number of appeals were lodged with the Constitutional Court over alleged irregularities in the handling of the case.
One related to Francisco Garcia, one of Rios Montt's defense lawyers, who had just won an appeal to be readmitted to the case. Garcia was thrown out when the trial began for repeatedly trying to have two of the three presiding judges recused.
When Garcia was reinstated, he tried to recuse the judges again, but they rejected his bid and proceeded with the case.
The Constitutional Court said the judges should have suspended the trial until the recusal attempt had been officially resolved. A spokesman for the court could not say how the recusal bid needed to be formally settled.
Disclaimer: I am not an expert on Guatemalan courtroom procedure. But my guess is that the matter was resolved, and in the way these things usually are: The judges take the request under advisement, consider the arguments and weigh the potential for conflicts of interest, and make their ruling. And very often, that ruling goes against the defendant — particularly when the defendant is poor and/or a member of an oppressed minority group. Powerful members of a country's ruling class are more likely to get the recusals they want, but even then, a lot of the allegations of conflicts are baseless, and judges tend to rule accordingly.
On the other hand, in a country with a number of other indigenous minority populations that have been — and in some cases still are — being subjected to genocidal campaigns, other members of the ruling class tend to get a little twitchy when one of their own is imprisoned for genocide. And as catilinus noted in a comment to my earlier diary, Mexico's Tzotzil Maya in the Chiapas region are fighting government efforts to exterminate them; Chiapas activist Juan Vázquez Guzmán was assassinated only last month. So regional pressure is likely coming from outside Guatemala's borders, as well.
Ríos Montt, meanwhile, has been transferred to a hospital, where he is reportedly being treated for "respiratory and prostate problems."

ANOTHER SUIT OVER REMAINS: FIGHT CONTINUES OVER JIM THORPE'S BODY
And speaking of death, the unseemly battle over the remains of the late Indian Olympian Jim Thorpe (Sac and Fox) turns ever uglier.
The former Mauch Chunk and East Mauch Chunk, Pennsylvania - merged towns with virtually no Native population of their own - have been known collectively for the last 60 years as Jim Thorpe, Pennsylvania. Why? Because after Mr. Thorpe's death in 1953, his third wife, incensed that Oklahoma did not create a memorial for him, made a deal with the two economically depressed Pennsylvania boroughs: She would help them attract tourism by donating selling his remains to be buried there; in turn, they would build monuments to her late husband, and merge and incorporate under the town name of "Jim Thorpe."
The tenuous connection upon which the whole project hung? Mr. Thorpe's attendance, decades earlier, at the Carlisle Indian School — which, of course, was located some 100 miles away. Oh, and the money the widow received from the sale of her late husband's bones.
Three years ago, Jim Thorpe's son Jack (himself now deceased) filed a NAGPRA lawsuit, demanding that his father's remains be repatriated to his native Oklahoma, where, he insists, his father wanted to rest with his ancestors. His surviving brothers have joined him in the suit. [On this issue, the linked article is badly written, making it appear from an out-of-context quote that Jack Thorpe wanted his father's body to remain with the town, but that is not the case.] NAGPRA, acronymic shorthand for the Native American Graves Protection and Repatriation Act, provides a legal mechanism for tribal members to force repatriation of the remains of other members (and associated artifacts and objects) that are being held illegitimately in museums or other sites. Last month, a federal judge in Pennsylvania gave Mr. Thorpe's survivors the green light to pursue repatriation under NAGPRA.
Time for some editorializing: The whole scheme was absolutely repugnant and positively ghoulish. My guess is that, were Jim Thorpe alive to make his wishes known, he'd support his son Jack's efforts to repatriate his bones back home. After all, he never so much as visited either Mauch Chunk or East Mauch Chunk while alive, and had no connection to the area whatsoever. I suspect that the Sac and Fox feel like many of our tribal nations do about what should be done with their members' earthly remains: When a person walks on, the remains are to be treated in accordance with tribal spiritual tradition, and then laid to final rest (whether buried, cremated, or something else) in the lands of their ancestors — not to be exploited as a money-grubbing tourist attraction for the exclusive benefit of non-Indians.
Predictably, the townspeople are outraged that anyone — even a son — would try to deny them their rights of exploitation. The Olympian's own cross-country coach, one Drew Benyo, hails from the former Mauch Chunk, and says that "Jim Thorpe is the name that feels right." He also says:
"There are a lot of people who have been here for a long time and can't understand how a contract that is 60 years old can suddenly be no good," he said.
Sixty years, Mr. Benyo? You want to whinge about 60 years? Let's see you do some work pushing to honor treaties that are hundreds of years old. Then maybe I'll listen to you complain about "60 years."
Then again, I probably still wouldn't.

HEALTH: DESPITE RECENT STRIDES, HIV RATES
IN INDIAN COUNTRY CONTINUE TO GROW
The Indian Health Service [IHS] has released a report detailing a spike in rates of HIV infection on the Navajo Nation, sparking fears of an epidemic. The rates show a five-fold increase since 1999. In 2012, 47 Navajo residents were diagnosed with HIV, a 20% jump from 2011.
The current reporting blames fear of stigmatization for the uptick in infections:
"H.I.V. in Indian country is very different than the rest of the world," said Dr. Susan V. Karol [Tuscarora], the agency's chief medical officer, according to The New York Times. "Our communities are very small, and that can lead to people avoiding stigma, rather than getting the care they need."
HIV, otherwise known as the Human immunodeficiency virus, is the virus that can lead to acquired immune deficiency syndrome, or AIDS. CDC estimates that about 56,000 people in the United States contracted HIV in 2006.
"I'm afraid that if we wait too long," Dr. Iralu said, "it could turn into a true epidemic."
What is not clear from the reporting, though, is whether that assumption is true. Media coverage does not even address the possibility that the heightened numbers might be due, at least in part, to greater numbers of Indians seeking treatment, which will undeniably lead to higher rates of reporting. Much work has been done in Indian Country in recent years on HIV education, awareness, and treatment — and probably nowhere with greater emphasis than on the Navajo Nation. In fact, I wrote about exactly this issue for National Native HIV and AIDS Awareness Day, in a piece last year for the First Nations News and Views series by navajo and Meteor Blades:
The Navajo Nation helps administer perhaps the most comprehensive programs currently in existence. The Navajo AIDS Network, founded by Melvin Harrison, partners with the Gallup [New Mexico] Indian Medical Center to provide counseling and case management services to Navajo patients diagnosed with HIV. The group also offers testing and educational services.
The GIMC itself is a valuable resource: Geared explicitly toward tribal members, it works closely with both the Indian Health Service and traditional hataa'lii [sic], or medicine persons, to provide comprehensive medical and spiritual healing for HIV and AIDS (as well as for any other illness, injury or condition).
The lack of awareness spurred the 2006-2007 Miss Navajo Nation, Jocelyn Billy, to make HIV/AIDS education and outreach the service program for her year in office. Ms. Billy connected with the young people, the group most at risk, and helped adults navigate the gaps between traditional ways and modern medical realities.
As of this writing, I have tried repeatedly and unsuccessfully to get my hands, or at least my eyes, on the actual IHS report itself. I finally returned to the original reporting from The New York Times, which did indeed link to the report — in a format I cannot open, much less read. If I can eventually read the actual report, I may be able to answer some of the obvious questions in a future edition.
Note to IHS: Your Web site is a dysfunctional embarrassment. It looks like an exercise in self-promotion and ass-covering, not a resource designed to help Indians navigate the health and medical care needs. You need to fix it. Seriously.

ARTS: ONCE AGAIN, THE NAMMYs BETRAY THEIR MISSION
What follows is not reporting. It's a rant. You've been warned.
The point of the Native American Music Awards, or NAMMYs, is supposed to be to showcase and reward outstanding Native American music. That would mean music by Native Americans, in each category — not by non-Natives exploiting Indian music, traditions, cultures, images, or identities for their own benefit.
Sadly, the NAMMYs have a less than stellar history in this regard, and this year's awards are a perfect example. [Aside: If you're looking for information about all the nominees and winners, you're on your own; after seeing this story, I was too fed up to care about the rest of it.]
The 2013 "Group of the Year" award went to a band calling itself Big City Indians. There's just one problem: They're not Indians. Hell, they're not even Americans.
"Big City Indians" could more properly be called "Big City Minstrels." They're a band based in Vienna, Austria, made up of Europeans, with occasional rotating token exceptions. This year's "token" is an allegedly Canadian vocalist whose vague and contradictory hints as to her ancestry (and her self-bestowed "Indian name," which likewise contradicts those vague hints, and bears no apparent relationship to the language from which it supposedly comes) are all highly suspect. The male band members, some of whom are blond, look like fugitives from bad '80s hair bands. The lead singer and front man is an Austrian guy who gave himself the fake "Indian name" of "Wolfsheart." Their discography to date, just from titles alone, clearly steals from at least three separate tribal traditions: Sioux, Navajo, and Ojibwe.
Note to the NAMMYs: This is NOT a "Native American group." This is bald-faced Redface minstrelsy in the form of a bunch of pretendian cultural thieves and con artists who occasionally use someone with actual Native ancestry (and sometimes not even that) to steal opportunities (and more) that should have belonged to, you know, actual Native American groups. Heaven knows there are enough Native bands out there; do your jobs and represent them, not a bunch of racist fakes.
Note to Wolfsheart: Leave my people out of your racist fakery, you thieving ass.
