Last week, former U.S. Senator Byron Dorgan published an op-ed in The New York Times outlining the devastating effects of the sequester in Indian Country.
Several of us have written about the sequester and its disproportionate effects on American Indians: Meteor Blades here; Ojibwa here; and myself here, here, here, here, and here. Throughout, the one consistent theme has been the devastation wrought upon already underfunded and underserved populations, those most desperately in need of assistance already. Affected programs include schools, health care, housing, nutrition assistance, elder care, and virtually every other aspect of daily living.
In his op-ed, former Senator Dorgan cites chapter and verse of this same old story that we all know too well:
- the child who, when asked what she wants for Christmas, wants her family's electricity turned back on so she can study for school;
- the high school wresting star whose coach paid personally to send him to the state finals, but no one could afford the extra expense of a hotel room, so the young man slept every night on the floor of the gym where the event was held;
- the fact that most, if not all, children at Pine Ridge personally know someone who committed suicide;
- the more than 100 reported suicide threats and attempts by children at Pine Ridge so far in 2013, as mental health services have been halted by sequestration;
- the closing of the rez youth center and summer youth employment programs due to sequestration;
- the young orphan who, after years of sexual abuse in foster care, found safety in shelter that is now closing, due to sequestration;
- the more than 200 homes in one section of Pine Ridge that have no electricity - and in some cases, no windows or doors; in other cases, no houses at all, with families forced to sleep in tents;
- an Indian Health Service facility unable even to see most patients after May, because there is no more funding.
None of these is new, but all are especially acute today. Much of Indian Country has virtually no safety net to begin with; sequestration is now forcing a high-wire act without even a wire.
Senator Dorgan's conclusion is blunt, and will be wildly unpopular with the dominant-culture leadership:
Congress should hold a series of investigative hearings on our unfulfilled treaties with American Indians. Add up the broken promises, make an accounting of the underfunding, all of it, and then work with tribes to develop a plan to make it right. In the meantime, we must exempt Indian country from sequestration — right now.
His conclusion is also right.
Note to The New York Times: Really? Really? In an important op-ed by a former U.S. Senator discussing the poverty and other obstacles facing Indians, you couldn't find one Native artist to provide the accompanying illustration, instead choosing to go with a white European artist's grossly stereotypical rendering that looks like Pocahontas the Corn Maiden Matryoshka Doll?

DESCENDANTS OF THOSE MASSACRED AT SAND CREEK SUE U.S. GOVERNMENT FOR PROMISED REPARATIONS, FINANCIAL ACCOUNTING
On July 11th, four American Indian plaintiffs filed suit in federal district court in Denver, seeking the reparations the federal government promised, under the Treaty of Little Arkansas River, to their Southern Cheyenne and Arapaho ancestors for the Sand Creek Massacre committed by Colonel John Chivington and his troops in 1864. The suit also demands an accounting of the funds originally allocated under the treaty, which were never paid. The plaintiffs seek class-action status for their claims.
i'm not going to recount the genocidal brutality of the Sand Creek Massacre here. Twice in recent months, Meteor Blades has written about Sand Creek, here and here. If you missed these diaries, read them; even if you read them the first time around, they're worth revisiting again. I also wrote about it tangentially back in February, here. In noting the savagery of the slaughter, I will, however, reproduce this quote from Captain Silas Soule, who refused to participate in Chivington's genocidal mayhem, was branded a coward for his ethics, testified against Chivington before Congress, and was himself assassinated in a Denver street thereafter. I am choosing not to redact the term "squaw," because the very fact of its universal and incorrect use by white men of the day is itself relevant. From a letter Soule wrote to General Edward Wynkoop:
"The massacre lasted six or eight hours, and a good many Indians escaped. I tell you Ned it was hard to see little children on their knees have their brains beat out by men professing to be civilized. One squaw was wounded and a fellow took a hatchet to finish her, and he cut one arm off, and held the other with one hand and dashed the hatchet through her brain. One squaw with her two children were on their knees, begging for their lives of a dozen soldiers, within ten feet of them all firing — when one succeeded in hitting the squaw in the thigh, when she took a knife and cut the throats of both children and then killed herself.... They were all horribly mutilated. You would think it impossible for white men to butcher and mutilate human beings as they did."
This, inflicted upon a peaceful group of noncombatants encamped under a peace flag raised under the Treaty of Fort Wise. And yet, Soule's account barely scratches the surface of the savage horror visited upon the Arapaho and Cheyenne that day.
In one particularly poignant passage, the claim notes that the plaintiffs "still have the bullet hole-riddled blanket" that Chief White Antelope wore as he went in peace to meet the troops in hopes of protecting his people. He was, of course, slaughtered at the outset.
Named as defendants in the suit are both the Bureau of Indian Affairs and the Department of the Interior, for their roles in managing (or mismanaging) the monies allegedly held in trust for the descendants of those massacred at Sand Creek.
Without having read the pleadings in this case, my initial reaction is that I will be very surprised if this claim survives. Then again, I was surprised that the Cobell litigation ultimately yielded some positive results. And Cobell may turn out to exactly the precedent needed to sustain such a cause of action. But even if the case ultimately goes nowhere, it still will likely be of great value, simply in raising awareness of the country's ongoing refusal to honor the treaties made with our ancestors.

SWINOMISH SUE SEATTLE SUBURB FOR GIVING AWAY
ANCESTORS' REMAINS AS "FREE DIRT"
The Swinomish Indian Tribal Community has filed suit against the Seattle suburb of Oak Harbor and three construction firms, accusing them of illegally disposing of remains of tribal members' ancestors.
The suit stems from an incident that occurred in 2011 during the local Pioneer Way road construction project. At the behest of the city, the construction firms bulldozed an area for excavation that the tribe says was known to contain an ancient village and a burial ground. The city was even warned by an official with the state's Department of Archaeology and Historic Preservation [DAHP] of the presence of a "known archaeological site" and advised to retain professional services to avoid damaging it. Further, the Swinomish allege that, when confronted, town and company officials attempted to cover up what they had done by loading the earth from the excavated area into a pile, labeling it "Free Dirt," and giving it away to city residents.
Dirt that included human remains of the Swinomish people's ancestors.
Oak Harbor officials profess confusion and distress:
Oak Harbor Mayor Scott Dudley said he is "perplexed" and "disheartened" by the filing of the claim, which is the first step taken before a lawsuit is filed.
Dudley claims Brian Cladoosby, chairman of the Swinomish Tribal Community, assured him that the city didn’t have to worry about a lawsuit as long as ancestral remains were handled appropriately.
"We were operating under the understanding that we would complete the recovery work and the reburial and that would be sufficient," Dudley said.
"We were under the impression that it would never come to this."
I can't imagine why. Recovery and reburial will not make the Swinomish whole. Of course, city officials are choosing to focus solely on the "recovery and reburial" part, ignoring the layers of damage done to the tribe's ancestry and culture.
In fact, the tribe's lawsuit seeks quite modest compensation: It notes that more than $600,000 has already been paid to provide for technical and spiritual guidance and assistance (which occurred, of course, after city and company officials were confronted). The damages now sought amount to only $9 million.
And Mr. Cladoosby has expressed an interest in keeping the parties out of court, if possible:
"Hopefully we’ll be able to sit down with the city and come to a settlement in the next 60 days and avoid going to court," he said.
The lawsuit was filed in April of this year, before the two-year statute of limitations ran out on potential claims. News of the litigation is only now leaking out beyond Oak Harbor and Whidbey Island.

JOHNNY DEPP FLOATS TRIAL BALLOON ABOUT BUYING
MASSACRE SITE AT WOUNDED KNEE
Soundly spanked both at the box office and in Native media for his recent stints in Redface, Johnny Depp has floated a trial balloon that appears to be designed to burnish his reputation. It has nothing to do with his "adopted" Comanche Nation (he was adopted by one tribal member, not the tribe itself), but it is Indian in subject matter.
I've written in the past about the greedy white man who holds title to land adjacent to the site of more than 300 Oglala Lakota massacred in 1890 by the 7th Cavalry. The land itself includes part of the mass grave holding the remains of some 150 Oglala, which is considered sacred ground by the descendants of those slaughtered there. The owner, James A. Czywczynski, has been trying to blackmail the tribe into buying the plot, which has been independently appraised at a market value of some $7,000 — for an asking price of $4 million. [Note: News reports are now listing the appraised value at $14,000, double that of reports from earlier this year; it's likely that the publicity surrounding Czywczynski's greed has resulted in an increased appraisal value.] The tribe has pointed out that the seller comes back every few years, demanding more money each time, always accompanied by threats to sell it to non-Indian interests.
Johnny Depp, late of Tonto fame, is making noises about buying it:
"It’s very sacred ground and many atrocities were committed against the Sioux there. And in the 1970s there was a stand-off between the Feds (Federal government) and the people who should own that land. This historical land is so important to the Sioux culture and all I want to do is buy it and give it back. Why doesn’t the government do that?"
Is he really prepared to pay for the land?
"I am doing my best to make that happen. It’s land they were pushed on to and then they were massacred there. It really saddens me."
Oddly, he does not seem to have had a single conversation yet with the tribal nation to whom the land originally belonged and whose ancestors are buried there.
Czywczynski, of course, is seeing dollar signs, and has pronounced himself "eager" to push through a deal with Depp. But some members of the Oglala Nation are already raising red flags:
Chuck Trimble of Omaha, a Native American rights advocate and journalist who is an enrolled member of the Oglala Lakota nation, is among those who think Depp should do something else with his money.
"I think it's very generous of him, but there are quite a number of people who wish he wouldn't do this," Trimble said. "If he wants to give millions, he should give it to a cause, and not pay it to a man who is holding the Wounded Knee site for a price — and it's very questionable how he got it in the first place."
Some people also clearly suspect that the whole point is simply more publicity and an attempt tp restore his reputation after his Redface debacle. There appear to be related concerns that, if he does buy the land in question, he ultimately will not turn it over to the Oglala with no strings attached. To that end, they have
"Keep your word. Promises to indigenous people are frequently made and broken. You promised to buy Wounded Knee and give it to the Sioux Nation. The owners want to sell. Keep your word. Buy Wounded Knee and gift it freely to the Sioux Nation."
I'm reading a lot about how wonderful this is for "the Indians," and how everybody should be thanking Johnny Depp, etc., etc.
I'm going Grumpy Cat now: No.
This is a teaching opportunity, and I'm taking it: Making Amends for Racism 101.
First: Before talking to anyone else, he should have gone, privately, to the tribal leadership and asked them what they want. Millions are at stake here: Perhaps they would rather use the money for much-needed housing and medical care, suicide prevention programs, shutting down Whiteclay, or any number of other pressing needs. And perhaps not. But the tribe should be the one to decide what needs addressing most in their communities, and how such money can best be used.
Second: With regard to the land in question, none of this is about Johnny Depp. Even if he buys it and returns it to the tribe, it's still not about him. It's about seeing that the right thing is done, which is that sacred ground stolen generations ago from massacre victims is returned to its rightful owners.
Third: As I said elsewhere the other day, doing something good doesn't erase having done something bad. Buying it and returning it to the tribe puts a hash mark in the plus column, but it doesn't erase the mark in the minus column over the [continued] episodes of racist minstrelsy. People can weigh the result for themselves. Doing the right thing by ensuring that the Pine Ridge Oglala's ancestors' burial site is returned to them in full should not be held hostage to receiving public acclaim or Indian street cred. And making his own amends for his bad behavior involves making amends, not deflection, not attempts to gain [very] public favor and/or personal benefit, and not Great White Savior-ism.
[A note about Depp's ancestry: Like many celebrities, Depp's genealogy has been run several times. It appears that there is absolutely no truth to his claims to Native blood; rather, it appears that his ancestors used that story to attempt to hide the fact that their heritage is actually part African American. If true, that makes the whole sorry episode even sadder, since it represents a continued attempt to deny a part of his actual ancestry that should, instead, be its own cause for pride.]

WORRIED ABOUT BEING "INSENSITIVE" TO ATLANTA BRAVES, NY METS CANCEL NATIVE AMERICAN HERITAGE Day
Talk about your unforced errors . . . .
Someone in the front office of the New York Mets had the idea to honor Indians with a Native American Heritage Day. Good idea, right?
So the team reached out to the American Indian Community House [AICH], a nonprofit community organization in Manhattan that serves urban Indians in the New York City metro area. AICH provides cultural support for Indians living away from their traditional lands and cultures and peoples, and also addresses needs such as nutrition assistance, diabetes counseling, behavioral health services, substance abuse programs, and youth programs, and tackles other systemic problems that urban Indians face.
AICH agreed to help the Mets create a Native American Heritage Day, and spent four months working to develop a program that would include Native singing, drumming, dancing, and other traditional activities. The date was set for July 25, and AICH was in the process of finalizing the program.
Then someone in the Mets' front office finally noticed what the team's planners and AICH already knew: who the visiting team would be that day.
The Atlanta Braves.
And on July 1, after four months of work by AICH and partnering organizations, the Mets effectively pulled the plug.
Why? They were afraid that having a Native American Heritage Day featuring actual Indians at a game against Atlanta would be insensitive to the feelings of the Atlanta team and its fans.
Got that? They're not worried about the feelings of the Indians who continue to be wronged by the Atlanta team's and fans' racism; they're worried about the feelings of the racists themselves.
"It was brought to my attention that we need to be sensitive to the Braves being a partner MLB team and can’t put them in a situation for a potentially negative environment to be brought upon them," the Mets official wrote. "I know this is not the plan, but sometimes people come to events under different agendas than expected. I’m not referring to [A.I.C.H.] or any of the organizations involved, but more about unknown groups that may want to change the perception of the event."
The privilege, it burns. And the stupidity, too.
Now, the Mets didn't cancel the event entirely. Oh, no. They just canceled all intrinsically Native activities. There would be no singing. There would be no dancing. There would be no drumming.
So what was left?
Needless to say, AICH pulled out of the process entirely. Now the Mets are left scrambling with a PR nightmare among Indians their allies.
Fortunately, AICH isn't remaining silent.
"Being a nonprofit in the city, we’re not in the business of making enemies," said Kevin Tarrant, the deputy director of the A.I.C.H., which describes itself as an organization that aims to "cultivate awareness, understanding and respect" for thousands of American Indians who live in New York City. "This whole thing wasn’t even our idea. But it just feels like we’re being marginalized again within our own community."
AICH education and development officer Rick Chavolla added:
"We’re not trying to be overly sensitive," . . . "but it seems like we fall into this type of thing a lot. We’re led to get enthusiastic about something, and then it’s like, 'Oh, never mind.' It’s disappointing, but it sort of amplifies a pattern of what we’ve been dealing with for hundreds of years."
If the Yanks keep Joba Chamberlain, I may have to start rooting for the Yankees.

11TH ANNUAL LORI PIESTEWA NATIONAL NATIVE AMERICAN GAMES
HELD IN FORT MCDOWELL, AZ
The 11th Annual Lori Piestewa National Native American Games kicked off last Wednesday at the Grand Canyon State Games, which bills itself as an "Olympic-style competition" for Arizona athletes. This year's Native Games encompassed seven separate sports. Collectively, entrants comprised "7 Baseball teams, 41 Softball teams, 20+ Volleyball teams and numerous Cross Country, Track and Field and Wrestling athletes."
The event, the largest all-Native sporting event in the country, is named for the late Lori Piestewa (Hopi), the first woman soldier to lose her life in George W. Bush's Vanity War the Iraq War, and the first Native American woman to die in combat.
Born on December 14, 1979, to a full-blooded Hopi father and a Mexican American mother, Lori Piestewa began life in Tuba City, Arizona. Her paternal grandfather was a World War II veteran; her father spent a year in-country in Viet Nam. In 2001, at age 21, she enlisted in the U.S. Army, attained the rank of Private First Class (she was posthumously awarded the rank of Specialist) in the Quartermaster Corps, and was assigned to the 507th Maintenance Company, which provided support services to the vanguard troops in Iraq. On March 23, 2003, her company's convoy got lost in the desert and was ambushed at al Nasiriyah. As one of the convoy's drivers, she managed to evade what the Army's official investigation described as "a torrent of fire" until a front wheel was struck by an RPG, causing her Humvee to crash into a disabled vehicle. She and two more soldiers survived the crash. while three others were killed; all three survivors were taken as prisoners of war by Iraqi forces. Then-PFC Piestewa sustained head injuries that would shortly prove fatal.
in addition to her promotion to Specialist, she was also posthumously awarded the Purple heart and the Prisoner of War Medal. Numerous landmarks and organizations all over the country have been renamed in her honor. One of the most significant is Arizona's decision to do away with the slur given to a local mountain peak, renaming it Piestewa Peak. And in 2003, the Grand Canyon State Games launched the Lori Piestewa National Native American Games to celebrate her life and memory.
Lori Piestewa's traditional name was Qötsa-Hon-Mana, or White Bear Girl. Her surname is said to come from the same root as a Hopi word that translates in English as "water pooled on the desert by a hard rain." As a young woman, she lived up to her traditional name through her military service; in death, her legacy continues to fulfill her surname's promise.
