The drastic Texas Abortion law State Sen. Wendy Davis filibustered for 11 hours was just reinstated when a three judge panel of the Federal 5th District Appeals Court lifted an injunction against implementing most of the law.
Appeals court lifts injunction on Texas abortion law
By Molly Hennessy-Fiske
...the 5th Circuit Court of Appeals panel sided with state officials who asked for an emergency stay so that the new law could take effect pending a final decision.
The panel found the state offered ample evidence that the admitting privileges requirement protected women’s health.
Oddly this new ruling takes the opposite approach the courts took in a similar appeal case against a Mississippi law set for trial in March where court ruled the new restrictions under court challenge could not be implemented during the appeals process.
Mississippi passed a similar law last year and faced similar legal challenges. After a federal judge blocked the law pending a trial in March, the state’s attorney general asked the 5th Circuit to lift a temporary stay and allow the law to be enforced in the interim, but they refused.
As the Republican Party's systematic attack chipping away at women's right to reproductive choice continues on the state level across the country this is a alarming setback. This ruling will close about a dozen or about a third of the clinics across Texas tomorrow in areas where hundreds of thousands of women live. It shows how precarious this right is becoming in some parts of our country.
