We have news from Florida, Georgia, Colorado, Washington, and North Dakota this week. We also have news from the Sixth Circuit.
In Florida, the plaintiffs pretty much threw a hail mary and filed a motion to have Judge Garcia lift the stay of his ruling/order. That motion was denied. Plaintiiffs' attoneys then asked the Third District Court of Appeals (in Florida) to vacate the stay on Wednesday. The state appeals court denied the motion without comment on Wed. afternoon.
In Georgia, the state defendants have filed a motion to have the marriage equality lawsuit in that state dismissed.
The Puyallup Tribal Council in Washington state passed an amendment allowing same-sex couples to marry.
In Colorado, the Pueblo County Clerk (reluctantly) decided to cease issuing marriage licences to same-sex couples in that county on July 21. A federal judge struck down the same-sex marriage ban in the state, and issued a preliminary injunction on Wed., July 23. The judge stayed his injunction till 8/25/14. And, AG Suthers has appealed the ruling to the Tenth Circuit. In the meantime, the Boulder County Clerk (Hall) continues to issue marriage licences to same-sex couples. AG Suthers latest attempt to stop the clerk (with a state appeals court) has failed.
In Louisiana, a federal judge has decided that additional oral arguments are not necessary to render a ruling in that marriage equality case. The judge had earlier heard arguments regarding out of state same-sex marriages.
In North Dakota, the plaintiffs in that marriage equality case have filed a motion for summary judgment.
The schedule has been set in the Alaska marriage equality case. The plaintiffs' motion for summary judgment is due on 8/22/14. And, oral argument in that case is set for 10/10/14. And, the Alaska Supreme Court unanimously ruled to allow same-sex partners access to survivor benefits on Friday.
And, the
Sixth Circuit has announced the three judge panel that will hear the marriage equality cases in that circuit on August 6. They are Judge Martha Craig Daughtrey (a Clinton appointee), Judge Jeffrey Sutton (a George W Bush appointee), and Judge Deborah L. Cook (a George W Bush appointee). It is interesting to note that the
Sixth Circuit was the most reversed of the circuit courts between 2005 and 2012.
