San Jose cops sued for stopping car carrying gunshot victim
A 16-year-old boy who was being driven to a hospital by friends after he was shot at a San Jose party died because police officers stopped the vehicle and then failed to provide medical help, the boy's father said in a federal civil rights lawsuit filed Thursday.
Gerardo Jorge Medina was struck in the stomach by a stray bullet fired at a party on the 10300 block of Murtha Road in eastern San Jose on June 13, 2013, according to the suit filed in U.S. District Court in San Francisco.
Gerardo's girlfriend, Destiny Chavez, and several friends put him in a car and were rushing him to an emergency room when their car was stopped by San Jose police near Story and South White roads, said the suit filed by attorney John Burris on behalf of Gerardo's father, Fernando Medina.
"Instead of rendering aid and calling for medical assistance," officers conducted a felony car stop without reasonable suspicion that anyone inside had committed a crime, the suit said.
The police ignored the pleas of the people in the car for assistance. Instead they made them all get out and questioned them. They then dragged the wounded boy out of the car. Only then did they finally call for medical assistance. He died before he could get to a hospital.
