Could Prop 8 become law again in California if SCOTUS upholds state gay marriage bans? Would a SCOTUS ruling reverse the lower court rulings that originally overturned Prop. 8? Seems to me that in fact be case. Can the legal types, SCOTUS watchers, and political types answer this question?
I have a lot riding on this. I got married in San Francisco in September 2013 and my spouse received his green card in 2014 based on that marriage. My believe that the SCOTUS will overturn the bans but I really don't trust the Roberts court. I don't put it past them to uphold those bans and cause chaos in the lives of tens of thousands couple who have married after their state marriGe bans were overturned by lower federal courts.
Thoughts anyone?
