The company Tower Loans is a predatory lender that provides installment loans such as for furniture in poor communities.
It makes little sense for any company to define proper attire in regards to gender, I'm guessing a male in a kilt will blow their fuses too.
But to insist that their employee dress in a manner that could only negatively impact the employees performance is beyond paternalistic and has been determined to be a violation according to the EEOC
The suit, filed in U.S. District Court for the Eastern District of Louisiana, alleges that Tower Loan violated Title VII of the 1964 Civil Rights Act, the federal law that protects employees from discrimination based on race, color, religion, sex and national origin. Courts nationwide have repeatedly recognized that Title VIIs prohibition on sex discrimination protects transgender workers.
Transgender people are due a fair chance at employment like anyone else, said SPLC staff attorney Sam Wolfe. But the transgender community faces unacceptably high rates of unemployment and poverty due to widespread workplace discrimination.
The Equal Employment Opportunity Commission (EEOC), the primary agency charged by Congress with interpreting and enforcing Title VII, has made clear that employers cannot fire or refuse to hire someone solely because they are transgender. Broussard earlier lodged a complaint with the EEOC, which concluded Tower Loans action violated Title VII.
However he was later called in by the company’s vice president and informed that he gender was not “in compliance with Tower Loan’s personnel policies” and he would need to sign an agreement stating that.
The document he was asked to sign read: I understand that my preference to act and dress as a male, despite having been born a female, is not something that will be in compliance with Tower Loans personnel policies.
I have been advised as to the proper dress for females and have been provided a copy of the female dress code. I also understand that when meetings occur that require out of town travel and an overnight room is required, I will in assigned to a room with a female.
Fortunately this companies discrimination is so blatant that what they did to their employee is actionable. Not like the whispered death threats in the store room far too many Transgender workers have to endure.
