The couple, Camryn, an Iraqi war vet who is transgender, brought his birth certificate that had has his female birth name. Alexis, the bride, brought the rest of the appropriate paperwork, paid and gave them to Kim Davis.
Kim Davis stared at the couple, obviously thought that they were straight, never looked at Camryn's birth certificate, stamped her cloven hoof on the document and the lucky two sped off to be married.
Apparently Davis just looked at the two as a loving couple who wanted to get married. Not as two people whose nuptials would cause churches to burst into flame, asteroid strikes, human-animal marriage, hurricanes and volcanic eruptions. She just looked at the couple as a, well- loving couple who wanted to get married. And that's just how she should view all couples that follow Kentucky State Law, not her interpretation of her religion that she applies to law. If, in the past, she hadn't refused to bar other couples from marrying by using her personal religious beliefs): atheists, Buddhists, divorced couples, pagans, concubines, etc., then she has no business interfering with Marriage Equality.
In issuing the above marriage license, the inimitable Ms. Davis made two mistakes. She never checked the birth certificates to verify the ages of the applicants. She assumed by looking at them that their ages were OK. So I believe she violated her duties as the clerk by doing this.
The second mistake was that she issued the marriage license well before the Supreme Court issued the Obergefell decision. Another mistake by Kim.
It's possible that there might be more charges brought against her for this.
Additionally, there was a demonstration around the Rowan County offices. Demonstrators had turned out to oppose Davis and were chanting and picketing. Camryn and Alex were showing their papers to the crowd. The Clerk's Office was scheduled to be open. Davis closed it when she became aware of the protest. There may be another charge that can be brought against her for this. See seems to treat the Clerk's office as her personal fiefdom.
Kim Davis and Liberty Counsel may have a much more complex package to deal with now than when they agreed to take the case.
Also, Liberty Counsel has sent a emergency appeal to Justice Sotomayor to allow Kim to continue to discriminate. The attorney took a rather sharp tone towards Sotomayor with what he said. I don't think Sotomayor was going to be a big fan of the appeal in any case, but the language used may push her over the edge.
It's over, Kim. If your religion is such a driving force in your life, in spite of multiple marriages and divorces, then get the to a nunnery and stay there.

Oh, one thing that I read on another site. Kim Davis is being referred to as KFC - Kentucky Fried Clerk.
