Mr. Mat Staver,
I know you almost certainly wish it were so, but it is not so, we are not the Theocratic States of America!
And honestly, we will never let America be turned into a Theocracy by you and your kind.
So let’s explore a few of the reasons why it is quite obvious that you either:
- Think America already is a Theocracy. OR
- Strongly desire to turn America into a Theocracy.
God’s law trumps U.S. law
Quoted from Rena Lindevaldsen, a Liberty Counsel attorney:
Lindevaldsen told students in a speech entitled, “Do Government Officials Have Authority to Impose Their Morals on Others?,” that any law that is not “consistent with Scripture” — or, more accurately, their interpretation of scripture — is no law at all, and therefore, officials are obligated to break such laws since “civil government only has the authority that God has established.”
Video of Lindevaldsen speech:
Wow, just wow! For the statements made by Lindevaldsen to actually be true, would be the very definition of a Theocracy!
Gays can just drive to another county
Davis and her lawyers argue that all 20,000 Rowan County residents must accommodate Davis’ personal religious views — views that she ordered all deputy clerks to follow — by driving to another county if they want to access government services.
“You drive 30 minutes in any direction in Kentucky and get a marriage license,” Staver said. “You don’t have to force Kim Davis herself to issue the license.”
Another statement in support of a theocracy. Why should anyone have to drive to another county to have their Civil Rights honored and respected?
A county clerk is a Public official and as such must uphold the LAW and not force their religious beliefs on others!
Furthermore, what happens if the next nearest county had the same policy as Davis? How about two counties over? How about the next state over? Would you have them drive to the other side of the country if needed just to have their Civil Rights respected?
Anti-religious test for office
While Davis may have exhausted her appeals in the case where couples challenged her refusal to issue them licenses, Liberty Counsel has tried to throw a Hail Mary by filing a lawsuit against the governor, alleging that enforcing the Obergefell is actually unconstitutional since it would “impose a religious test as a qualification to hold the office of county clerk.” The group even argued, like Fournier, that issuing marriage licenses would violate her oath and represent anti-Christian discrimination:
No, Staver, the Governor is actually upholding his Oath of Office and enforcing the Constitution. It most certainly is not a religious test to demand that a Public Official uphold their lawful duties and the Constitution which they also swore an Oath to uphold!
Your lawsuit is frivolous and of course you will lose. I think you know that but you want the publicity and the donations from other like minded right wingers like you!
Before taking office as County Clerk in January 2015, Davis swore an oath to support the constitutions and laws of the United States and the Commonwealth of Kentucky “so help me God.” Davis understood (and understands) this oath to mean that, in upholding the federal and state constitutions and laws, she would not act in contradiction to the moral law of God, natural law, or her sincerely held religious beliefs and convictions.
Of course you know that you are purposely twisting her oath to mean what you WANT it to mean! so help me God means the same thing as I swear on my life to support the Constitutions and laws of the United States and the Commonwealth of Kentucky. The oath is to the Constitution, not God!
Governor Beshear’s targeted and discriminatory marriage policy pronouncements constitute government-imposed pressure on Davis to act contrary to her religious beliefs, and expose Davis to potential liability if she refuses to compromise her religious beliefs and violate her conscience.
No it isn’t, it is simply putting pressure on her to do her job as a Public Official and honor her Oath of Office.
No one is pressuring her to change or compromise her religious beliefs! She can believe whatever she wants but in her capacity as a County Clerk she must follow the law…period!
Allegations that as Dean of Liberty University you encouraged your law students to defy court rulings and laws that go against their Christian beliefs and to engage in Civil disobedience

And you are certainly giving Kim Davis very bad legal advice! You are not acting in her best interest, you are acting only in your OWN best interests!
I assure you Mat Staver, you will not get the Theocracy in America that you so apparently yearn for! We will stop you!
End letter to Mat Staver.
Now for a couple of other points offered in defense of Kim Davis.
Davis was elected before Obergefell, so she’s exempt
Following statement by Keith Fournier who is the Editor in Chief at Catholic Online:
In one positively bizarre defense of Davis, Keith Fournier said that Davis’ oath to uphold the laws only requires her to uphold the laws that were in effect before January 2015, when she was sworn into office.
Yeah that is bizarre alright but honestly, not surprising coming from a right winger.
Imagine the country we would be living in if Public officials, or even privately owned businesses opened to the public only had to obey laws that were on the books when they got elected or started their business!
Where exactly do people come up with such bizarre ideas? I mean really!
Davis is the only clerk obeying the law
Or how about this statement from none other than Mike Huckabee?
Mike Huckabee has been making the case that Davis is the only clerk upholding the law and that it is actually the vast majority of clerks who are issuing marriage licenses to same-sex couples are the ones breaking the law.
As Huckabee said on MSNBC yesterday, marriage equality can only be legal in Kentucky if the legislature passes a same-sex marriage bill that the governor signs into law, adding that the Supreme Court’s Obergefell decision is invalid because the court “cannot overrule the laws of nature and the laws of nature’s God.”
And to think Huckabee is running for the highest office in America and has such a complete misunderstanding of America’s Constitution and way of life!
So Huckabee, apparently you too think that America is or should be a full blown Theocracy! Sadly, that does not surprise me in the least!
America’s laws are based on the Constitution, not God and your God and your religious beliefs are completely immaterial to the laws in America!
Kindly cancel your run for President and go back and retake remedial Civics classes and don’t run for President again until you actually understand the Constitution and the American way of life!
How about a bonus video from Pat Robertson? (The bonus part is snark but take a listen anyway)
Don’t you get the impression that Pat Robertson is just getting plain senile in addition to being a right wing bigot?
