The U.S. Supreme Court decided three cases on June 28, 2004 which dealt with the right of the administration to detain people as "enemy combatants" in the war on terror and hold them indefinitely without judical review. These cases established that there were real limits on the President's power to detain people even with something akin to a declaration of war.
