So, San Fransisco's mayor has decided to go out on a limb and start marrying gay couples immediately. He directed his clerks to immediately cease discriminating against same-sex couples in the distribution of marriage licenses. So, we've all been able to enjoy the happy site of loving, dedicated couples getting married. Well, I think it's happy. Some people disagree.
But the major talking point on the right is that what the Mayor of San Fran has done is illegal. And, to be fair, I suppose they have a point. I mean, California has laws on the books which ban gay marriage, and there was also a public referendum which came to the same conclusion. But the issue, legally speaking, is far more complex. Indeed, the reason I decided to come to law school is because I became annoyed by the media's failure to adequately cover the legal, as opposed to political, issues surrounding Bush v. Gore.
