4th Amendment and "Domestic Military Operations"

Speechless... From AP and TalkingPointsMemo.com quoting a classified Justice Department memo (October 2001):
"Our office recently concluded that the Fourth Amendment had no application to domestic military operations"

I'm just dumbfounded. From AP:
"For at least 16 months after the Sept. 11 terror attacks in 2001, the Bush administration believed that the Constitution's protection against unreasonable searches and seizures on U.S. soil didn't apply to its efforts to protect against terrorism."
I'm sorry for the brief post, but it is worth repeating again

EVERYTHING IN THE US IS SUBJECT TO THE U.S. CONSTITUION. The Executive, the Judiciary, the Legislature. EVERYTHING. A fourth grader could tell you that, and they'd be correct.
I'm sorry for the inflammatory and short post, but I'm just so angry about this I felt the need to write. I want to know details. The American people deserve details. Congress, perhaps some questions are in order? I seem to recall a certain Oath of Office...
Article II, Section I of the U.S. Constitution
"I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."
Apparently his "ability" wasn't good enough... And just to reiterate, it's not just "preserve and protect" the Constitution, he has to DEFEND it. Not even close.
