Fund says:
"On Thursday, April 20, the 11th U.S. Circuit Court of Appeals--the same court that rejected the pleas of Terri Schiavo's parents last week--turned down the Justice Department's request to order Elian removed from the home of his Miami relatives."
Well, that's easy. That's a bald faced lie. The 11th circuit injunction prohibited Elian from leaving the UNITED STATES, not the HOME OF THE MIAMI RELATIVES. It's right there in the opinion in black & white:

Fund says:
"The Reno Justice Department acted the next day to short-circuit a legal process that was clearly going against it."..."Elian was quickly returned to Cuba..."
Oh Johnny, why must you play with the English language in this manner in order to mislead us? The above makes it appear that the courts ruled against the administration, so Reno quickly took Elian and sent him back to Cuba. Not so.

The INS asserted that on the question of political asylum for Elian, only his father spoke for him. The Miami relatives appealed in U.S. District Court. In March, the court ruled for the administration.
The Miami relatives appealled to the 11th circuit. Reno complied with the injunction forcing Elian to stay in the U.S. On 6/1/00, the 11th circuit ruled for the administration.
The Miami relatives appealed to SCOTUS. On 6/28/00, SCOTUS denied cert (would not take the case). The legal process exhausted and the administration victorious, Elian was free to return to Cuba.
But you wouldn't know that by reading the "selective restraint" of John Fund.
