Jefferson Beauregard Sessions III wants everyone to know he is still capable of throwing a hissy fit.
Sen. Jeff Sessions (R-Ala.) repeatedly said before Kagan's confirmation hearings began that he would leave open the possibility of a filibuster. He repeated that stance Thursday in the midst of the hearings, which are on break.
"The filibuster is not off the table," he told the conservative Human Events magazine, cautioning "it's not something that we do routinely for a nomination to a federal court."
He goes on to say that "You don't filibuster except under extraordinary circumstances," as though anyone evaluating Elena Kagan would truly find her extraordinarily unqualified for the court. Sessions, of course, provides no real basis for that potential filibuster. Because, of course, there is no reason to start injecting substance into the discussion of this nomination now.
