Independent Whistleblower Agency Targeted in FBI Raid

The FBI has raided the offices of the independent government agency established to protect federal whistleblowers. On Tuesday, more than a dozen agents made off with computers and documents belonging to Office of Special Counsel head Scott Bloch. Bloch has been accused of obstructing a 2006 inquiry into his conduct. But critics say the FBI could be trying to intimidate Bloch as he leads probes into the Bush administration. Bloch’s investigations have focused on the firing of US attorneys and the alleged use of federal agencies for political ends.

Something Smells Fishy: FBI Investigation of Scott Bloch

Yesterday the FBI raided the office and home of Scott Bloch, Special Counsel in the Office of Special Counsel (OSC).  According to news reports, Bloch's staff was told to log-off computers.  Computers and documents were seized.  While the FBI had no comment, staff at the OSC believe the raid is related to a 2005 investigation of allegations that Bloch retaliated against whistleblowers.  Additionally, the FBI presumably is investigating Bloch's purging of computer files in 2006.

This story (and my first diary!) will probably get lost in today's primary mania, but it will be interesting to see what comes out of this breaking news.

I hear on NPR (link to NPR story) that the FBI is conducting raids on two offices of the Office of Special Counsel , one in DC and the other in Dallas, I believe. This apparently is the next step in a long investigation into the activities of the OSC's chief, Scott Bloch, and his staff. The developing story is on the WSJ site as well.

WASHINGTON -- Federal Bureau of Investigation agents raided the Office of Special Counsel here, seizing computers and documents belonging to the agency chief Scott Bloch and staff.

More than a dozen FBI agents served grand jury subpoenas shortly after 10 a.m., shutting down the agency's computer network and searching its offices, as well as Mr. Bloch's home. Employees said the searches appeared focused on alleged obstruction of justice by Mr. Bloch during the course of an 2006 inquiry into his conduct in office.

Torture in the U.S.: The Ongoing Narrative the Media is Ignoring

Hot off the wire today, apparently the CIA has over 7,ooo documents relating to our government run torture program. Of course, we ain't gonna see 'em. If we do I'm sure they'll include pages upon pages of blacked out paragraphs. Heck they didn't even want to admit they have them until now.

Of course this speaks to the larger issue of the land of the free authorizing the use of torture on it's own citizens and the citizens of other countries. People who have been declared "enemy combatants" but many of whom have been found to have been erroneously captured.

Dear Friends,

This morning during a hearing in the House Judiciary Committee, I questioned FBI Director Robert Mueller on his agency's response to claims - made by his own FBI agents - that the CIA was torturing prisoners.  I wanted to find out why, if the FBI's own agents had alleged illegal actions were taking place, there was no investigation into the CIA's illegal and immoral practices.

Mueller's responses, which I would like you to read below, create new concerns and call for further investigation in the days ahead.

Austin police said Thursday that they are leaning toward a ruling of suicide in the death of a middle school teacher and activist whose body was found Wednesday in Lady Bird Lake with his hands and legs bound and tape over his eyes.

This is just too much:

In a speech to the American Bar Association, Mueller asked the assembled defense lawyers for help in "creating a culture of integrity" by reporting evidence of wrongdoing by politicians and corporate executives alike.

"Anyone who follows the news these days and sees repeated references to corporate fraud and public corruption might think the nation is in the midst of a moral crisis," Mueller told the defense attorneys. "Have we as a society become more corrupt? Or have we in the FBI simply become more adept at rooting out fraud and corruption?"

This coming from the man whose own agency purposely delayed a terrorism-related investigation in order to try to expand its already out-of-control NSL program, and in doing so, incidentally, apparently conspired to lie to Congress about it?

Corporate fraud is causing our moral crisis? Corporate fraud? Coming from a representative of an administration that spies illegally on Americans? That knowingly lied to take the nation to war? That TORTURES?!!?!?!? Gah!!!!

Government to Collect DNA from All Arrested of a Federal Crime

Welcome to the United States of Gattaca. The Washington Post is reporting that the Bush administration is expanding DNA collection of people arrested for crimes.

The U.S. government will soon begin collecting DNA samples from all citizens arrested in connection with any federal crime and from many immigrants detained by federal authorities, adding genetic identifiers from more than 1 million individuals a year to the swiftly growing federal law enforcement DNA database.

The policy will substantially expand the current practice of routinely collecting DNA samples from only those convicted of federal crimes...

Anyone now arrested of a federal crime will have their DNA collected. With the past examples of abuse of the justice system by the Bush administration, it isn't difficult to imagine how this change in policy could be abused. When the policy is implemented, roughly 1.2 million people a year will have their DNA collected.

"Liberty City 7" Case Ends in Second Mistrial

Remember those seven Americans from Miami who were accused in June 2006 of plotting to destroy the Sears Tower in Chicago? The government's second attempt at prosecuting them has resulted in a mistrial:

The decision comes after 13 days of deliberation and marks the second time government prosecutors have failed to convince a jury that the six defendants were guilty of terror-related charges.

It is unclear whether the government will pursue a third trial against the defendants.

Conspiracy to Lie to Congress?

Via mateosf, FBI director Robert Mueller and his agency might be in some serious trouble.

The Electronic Frontier Foundation has just published a report on the misuse of a National Security Letter by the FBI. Using the Freedom of Information Act, they obtained FBI documents showing that the FBI purposely delayed an investigation in the 2005 London bombings. From the EFF blog:

FBI documents show that, over the span of three days in July 2005, the Charlotte Division of the FBI first obtained educational records pursuant to a grand jury subpoena, and then -- at the direction of FBIHQ -- returned the records and sought them again pursuant to an improper NSL.

The improper NSL was refused by the university, but the FBI finally obtained them pursuant to a second grand jury subpoena. Later in July 2005, FBI Director Robert Mueller used the delay in obtaining these particular records as an example of why the FBI needed administrative subpoena power instead of NSLs in testimony.

The misuse of the NSL was not formally reported until February 2007, a short time before Inspector General Glenn Fine’s report on the abuse of NSLs was due before Congress. While the Inspector General's report identified dozens of instances in which National Security Letters may have violated laws and agency regulations and were not reported, this is the first time documents have shown that top FBI executives were aware of a misuse before it was officially reported. It took almost two years before the incident was formally reported.

Ryan Singel at Wired fills in a few gaps:

At issue is the FBI's probe of a former chemistry graduate student at North Carolina State University who was then suspected aiding the deadly attack.  The student has since been cleared of any involvement.

The agent investigating the student in the Charlotte, North Carolina field office obtained a grand jury subpoena demanding some university records on the student. But he was then advised by superiors in Washington DC to return the papers and draft an NSL demanding the documents instead.

Under the USA Patriot Act, FBI counterterrorism investigators can self-issue such letters to get phone records, portions of credit reports and bank records, simply by certifying that the records are relevant to an investigation. Unlike subpoenas, NSLs do not require probable cause, and at the time obliged the recipient to not discuss the demand with anyone, ever. In contrast, gag orders attached to grand jury subpoenas have expiration dates.

FBI agents have relied heavily on the power, issuing more than 100,000 NSLs in 2004 and 2005 combined. The first audit of the FBI's use of the power found the agents became sloppy in their use of the power and one HQ office went rogue and issued hundreds of fake emergency requests for phone records.

The FBI knew that the university records were not obtainable via an NSL, and the university properly rejected that request--a request that had already fulfilled once, legally in response to a grand jury subpoena. And which was fulfilled, again, when the FBI field office came back with the proper subpoena after the whole exercise in NSL futility.

An exercise that has all the appearances of having been set up for Robert Mueller to appear two weeks later before a Senate committee.

Mueller, testifying before the Senate Judiciary Committee, portrayed the university as intransigent and said the incident showed the FBI needed the power to force the turnover of all sorts of records without having to involve the court system.

"Now in my mind, we should not, in that circumstance have to show somebody that this was an emergency," Mueller testified on July 27, 2005. "We should've been able to have a document, an administrative subpoena that we took to the university and got those records immediately."

Some of the declassified documents suggest that Mueller was himself misled by underlings, and wasn't told that the records had already been turned over in response to a subpoena.

It would appear officials in the FBI, at very high levels that may or may not have included Mueller, conspired to lie to Congress. That would be a felony. It also raises the question of whether there are other violations of NSLs that have never been reported and that the FBI might still be trying to keep under wraps.

The Senate Judiciary Committee has an already scheduled hearing about NSLs. It's been postponed from tomorrow to the following Wednesday, April 23, and hopefully the witness list will be expanded to include Mueller. He's got some explaining to do.

Surprise, surprise, the FBI gamed its data to support its push for dictatorial spying powers for the Pretzelnut. Wired's got the scoop from EFF:

Counterterrorism officials in FBI headquarters slowed an investigation into a possible conspirator in the 2005 London bombings by forcing a field agent to return documents acquired from a U.S. university. Why? Because the agent received the documents through a lawful subpoena, while headquarters wanted him to demand the records under the USA Patriot Act, using a power the FBI did not have, but desperately wanted.

The Case Against NSLs

Today’s a big week for National Security Letters, the secret government subpoenas issued to gain access to personal or business records without court approval. There’s a hearing tomorrow in the House Judiciary Subcommittee on Constitution, Civil Rights and Civil Liberties and another hearing Wednesday in front of the full Senate Judiciary Committee. Tomorrow’s hearing features not only the ACLU but the DOJ Inspector General himself, Mr. Glenn Fine, and FBI General Counsel Valerie Caproni. The government panelists will go first but we’ll be there, ever watchful, until it’s our turn to step up to the mic.

OMFG... I never write diaries.  Ok, not in a long time, and then not often.  It is late, and I am tired, but I had to post this.

It is on Memphis news, and just BLEW me away.  This is REAL, not a a snark or anything.  

I NEVER believed it would happen here, but it has and is.  Again, OMFG, what have we come too?  How can something like this happen?? They are targetting people due to race, nothing more.  I know that that here in Memphis that .... we some are not as enlightened as others.  But how can this be legal?

I understand crime is very very bad here in Memphis, but "looking" for terrorist..  lets get real..
