How Trump's "Secret Plan" with Speaker Mike Johnson can lead to Trump's 2nd Term

I wouldn't like this "Secret Plan" any more than anyone else here at dKos would, but here's a step-by-step guide to a Constitutionally-valid coup that I think could technically work:

(1) Trump/Vance lose the election…

(2) Old R-led House majority impeaches VP Harris under Speaker Mike Johnson on the night of Jan 2, 2025, before the new Congressional term begins on Jan 3, 2025…

(3) After Jan 3, 2025, but before Jan 6, 2025, the new R-led "Supermajority Senate" immediately takes up the Impeachment charges before all other Senate business, as required by law (including postponing the seating of new D-Sens-elect), then convicts, thus removing, current D-VP Harris, and then still holds off on seating new D-Sens-elect…

(4) Without a VP in office, R-led "Supermajority Senate" chooses a "Pres Pro Tem" to oversee Jan 6, 2025, then rejects enough slates of Electors to leave neither Trump nor Harris with a majority of Pres Electors, and neither Vance nor Walz with a majority of VP Electors, thus sending the Pres election to the House and the VP election to the Senate…

(5) New R-"State Delegation Majority" House (led by a D or R Speaker being irrelevant!) immediately chooses Trump for Pres…

(6) New R-led "Supermajority Senate" immediately chooses Vance as VP, and only then seats incoming D-Sens-elect…

(7) Voila! Trump's Constitutionally-valid coup is begun on the night of Jan 2, 2025, and is complete by the night of Jan 6, 2025!

Now go ahead and tell me that Trump wouldn't try to pull off this "Secret Plan" with Speaker Johnson if he thought he just might get away with it.

Let us assume that the 14th Amendment does preclude Donald Trump from serving again as president because he "participated" to some degree in an insurrection on Jan 6, 2021…

Let us further assume that he wins the Republican Party's 2024 nomination for president…

In actual fact, only the names of Electoral College delegates pledged to the nominee (as well as those pledged to the nominee's opponents) appear on any general election ballot…

Let us finally assume that none of Donald Trump's Electoral College delegates are themselves disqualified from service as presidential electors…

Here's my question...

What would happen if Donald Trump were to garner the necessary 270 Electoral Votes needed to win the presidency as reported to the US Senate with the vice president presiding at the 2024 equivalent of Jan 6th?

Who decides, and when, that his 270+ Electoral College votes don't matter because he's not "qualified" to be president?

I confess that I've been worried that the GA Special Election Runoff on Jan 5th was hopeless because, at first glance, it seemed like there were way too many Republican votes compared to Democratic ones... At least, I was worried until I got mathy with the numbers…

I assumed that all major party voters would remain loyal to their party, and I looked into all the other candidates' backgrounds to see which major party I thought their voters would migrate to... The bottom line is that breaking down the numbers this way, the results of the general election become 48.9% DEMOCRATIC and 51.1% REPUBLICAN…

So, y'know what? The Georgia Special Election Runoff coming up on January 5th is EMINENTLY WINNABLE!

Foolishly, Arizona decided to allow restaurants to open yesterday, so I was curious to see how busy they are inside the store. It's been about an hour now, and... Zip... Zero... Nada...

On an otherwise pleasant Saturday evening, NOBODY is going inside to eat, but meanwhile, the drive-thru has been going non-stop...

Our corporate overlords, their political puppets and angry minions may have gotten the right to open their businesses, but there aren't ANY customers going in. Maybe people aren't as stupid as we feared!

Russian overland access to their naval base in Tartus, Syria

(1) Putin craves overland access to the Russian naval base in Tartus, Syria, so he can control the nearby Suez Canal to cut off easy access to Middle East oil making Russia's mafia-owned (a.k.a. Putin's) oil reserves much more valuable, so that ultimately, he can reconstitute the (highly profitable) USSR.

(2) Trump craves building a massive hotel and casino in Moscow.

(3) Putin and Trump have a Russian mafia money-laundering relationship since the 1990's, so they conspire to help each other.

(4) Putin, first, takes control of former-soviet Georgia's highway infrastructure, then second, makes Turkey's Erdoğon and Syria's Assad his dictatorial vassals, then third, Putin ensures Trump wins in 2016, then forth, at the right moment Trump suddenly get us out of the way of Kurdish-held Syria, then Voilà!, Putin can finally have his overland access to Tartus though Russia, Georgia, and Turkey, and into Syria.

(5, coming soon) Trump gets himself impeached out of office asap so Putin can give him his Trump Tower Moscow.

Does Trump have the intellectual capacity to create and execute this plan? Hell no, but Putin does, and he also knows how to manipulate Trump's huge narsiccistic ego into going along with it, democracy be dammed.

This will go down in history as one of the world's greatest political gambits. Wherever they may be, Sun Tzu, Augustus, and Machiavelli are bowing down in humility before Putin.

By insisting that decades of experience be acquired before assuming positions of significant leadership, and since the Baby Boom generation is the first to truly exhibit vastly increased lifespan thanks to medical science, you condemn all succeeding generations to remain subordinate to Boomers until Boomers have led for many more decades than has been historically the case.

There shall be, and are, numerous officials of post-Boomer generations who are as fully capable (and perhaps moreso) as Boomers with a few more years of experience. Such a policy further will result in rule of the country only by very-senior citizens, condemning younger generations to the whims of their grandparents and great-grandparents, let alone their parents.

I think it's entirely reasonable to believe that Boomers have totally screwed this country up -- Bill Clinton's fealty to Wall Street ruined the last vestiges of the once-great American Middle Class, Newt Gingrich weaponized legislative rules and introduced a vitriol to political discourse not seen since the 1850's, George W Bush turned the presidency into a vassal of the Military-Industrial Complex, Mitch McConnell made a mockery of Senate tradition, Barack Obama turned his party into an electoral shambles for a decade, and Donald Trump is the "Worst President Eva" turning allies against us, advancing the interests of foreign dictatorships, and yes, conspiring with nuclear adversaries to get himself elected, and the Supreme Court has become its most partisan in our entire history.

Truly, Boomer Rule has sucked for our country, and it's time for a f***ing change. Let that change begin NOW in the House. Vote NO on Pelosi.

Well, I've known Dave and his wife Abby for years, and along with Gosar's siblings, I wholeheartedly endorse Dave's campaign, too!

My friend Dave is a doctor, teacher, and businessman (along with being a very talented choral baritone, which is how I met him), and I can think of no-one more perfect to represent the people of this vast, rural district in western and central Arizona, and work hard for the issues we really need an effective Representative to fight for…

So how would this be for high drama on the Senate floor for Kavanaugh's final confirmation vote:

1- 48 out of 51 Republicans vote YES... [48-00],

2- 48 out of 49 Democrats vote NO... [48-48],

3- THEN Joe Manchin (D-WV) votes YES to get re-elected from his red state... [49-48],

4- THEN Susan Collins (R-ME) and Lisa Murkowski (R-AK) each vote NO on conscience... [49-50],

5- At this point, VP Mike Pence emerges to cast the tiebreaking vote, if necessary…

6- THEN Jeff Flake (R-AZ) honors the memory of the late John McCain (R-AZ), whom Trump insulted horribly, by using a dramatic "thumbs down" to vote NO while looking into McConnell's eyes, thus defeating Kavanaugh's confirmation, with final Senate vote of [49-51].

It would be the kind of bold rebuke of Trump and Trumpism that history would record long into perpetuity!

A Plan for SCOTUS Term Limits

We should amend our Constitution to establish nine Supreme Court Justice seats, each having an eighteen-year term, staggered to begin one of the nine seats every two years on the first day of October of odd-numbered years.

This regimen would ensure that Supreme Court appointments may be thoughtfully considered by the electorate during each regularly-scheduled election in November of even-numbered years, and it would guarantee to each new four-year presidency two regular Supreme Court nominations, and to each new six-year Senate class three regular Supreme Court confirmations.

The President should be required to send three nominees to the Senate for their consideration by the first day of April, and the Senate should be required to confirm one of these three by the first day of June. Failure by either the President or the Senate to meet these deadlines should result in the offended entity being granted the right to appoint immediately the new Justice without input from the offending entity.

In no case should any regularly-appointed Justice be eligible for re-appointment to the Supreme Court. If the number of active Justices should ever fall below nine, then a special appointment process should begin that day with the President having until the sixtieth day after the vacancy begins to send three nominees to the Senate, and with the Senate having until the nintieth day after the vacancy begins to confirm one of these three, with similar penalties for failure to meet these deadlines. Specially-appointed Justices should begin their service immediately after their appointment. No specially-appointed Justice who has served more than nine years should be eligible for nomination to the Court. Thus, the longest any person could conceivably serve on the Supreme Court would be twenty-seven years.

In practice, the office of Chief Justice of the United States has proven to be minimally administrative and largely symbolic. If the office of Chief Justice should be vacated, then an offer to fill the office should pass immediately to the most senior of the sitting Associate Justices who, within ten days, may elect to decline the offer, in which case the offer should then pass immediately to the next most senior Associate Justice, and so on. The Chief Justice may, at any time, elect to vacate the office of Chief Justice without abandoning their seat as an Associate Justice.

This new regimen should begin immediately. Until the nine current Justices vacate their seats, their lifetime appointments should be honored, which implies that the Supreme Court may transitionally have more than nine Justices, with conceivably, but unlikely, up to a transitional maximum of eighteen Justices. No doubt the Supreme Court will endure its Justices sharing such a temporarily crowded bench.
