<title>Hawaii coffee farmer loses deportation fight after nearly three decades in U.S.</title>
<link>https://www.dailykos.com/story/2017/7/10/1679362/-Hawaii-coffee-farmer-loses-deportation-fight-after-nearly-three-decades-in-U-S</link>
<description>&#x3C;p&#x3E;&#x3C;span&#x3E;This is a disgrace. Andres Magana Ortiz, an undocumented dad who worked his way from migrant coffee farmer to entrepreneur,&#xA0;&#x3C;a href=&#x22;https://www.washingtonpost.com/news/morning-mix/wp/2017/07/10/facing-deportation-hawaii-coffee-farmer-father-of-three-returns-to-mexico-after-28-years/?utm_term=.5798bd5dafb7&#x22; target=&#x22;_blank&#x22;&#x3E;lost his deportation battle after nearly three decades in the U.S.&#x3C;/a&#x3E;&#xA0;The father of three American citizens had garnered immense attention&#xA0;during his bid to stay in the U.S., including letters of support&#xA0;from &#x3C;a href=&#x22;https://www.dailykos.com/story/2017/6/9/1670289/-Hawaii-coffee-farmer-wins-last-minute-stay-of-deportation-but-his-fight-isn-t-over-just-yet&#x22; target=&#x22;_blank&#x22;&#x3E;Hawaii&#x2019;s entire congressional delegation&#x3C;/a&#x3E; and J&#x3C;/span&#x3E;&#x3C;span style=&#x22;text-align:start&#x22;&#x3E;udge Stephen Reinhardt, who, though legally unable to stop Magana Ortiz&#x2019;s deportation, &#x3C;a href=&#x22;https://www.dailykos.com/story/2017/5/31/1667584/-Federal-judge-blasts-Trump-s-deportation-force-Even-the-good-hombres-are-not-safe&#x22; target=&#x22;_blank&#x22;&#x3E;wrote in a &#x201C;scathing&#x201D; opinion&#x3C;/a&#x3E; that&#xA0;&#x3C;/span&#x3E;&#x3C;span&#x3E;&#x201C;the government decision shows that even the &#x27;good hombres&#x27; are not safe.&#x201D; &#x3C;/span&#x3E;&#x3C;/p&#x3E;

&#x3C;p&#x3E;&#x3C;span&#x3E;Facing a deportation date in just days, Magana Ortiz &#x201C;voluntarily&#x201D; left Hawaii for Mexico last Friday, a decision that was anything but voluntary:&#x3C;/span&#x3E;&#x3C;/p&#x3E;

&#x3C;blockquote&#x3E;
&#x3C;p style=&#x22;text-align:start&#x22;&#x3E;&#x201C;Very, very sad and very disappointed in many ways, but there&#x2019;s not much I can do,&#x201D; he&#xA0;told&#x3C;span&#x3E;&#xA0;&#x3C;/span&#x3E;&#x3C;a href=&#x22;http://www.hawaiinewsnow.com/story/35836079/time-runs-out-for-respected-kona-farmer-in-deportation-fight&#x22; target=&#x22;_blank&#x22;&#x3E;Hawaii News Now&#x3C;/a&#x3E; from the airport. &#x201C;Just follow what I have to do and hopefully, in a little bit, things can get better.&#x201D;&#x3C;/p&#x3E;

&#x3C;p style=&#x22;text-align:start&#x22;&#x3E;His flight took him from Hawaii to San Francisco to Houston. From there, he flew to Morelia, a city of 785,000 in central Mexico close to the village he left when he was a teenager. He will stay with friends for the time being and try to get in touch with a distant aunt, his lone blood relative in the country, he told local media.&#x3C;/p&#x3E;

&#x3C;p style=&#x22;text-align:start&#x22;&#x3E;His oldest child, 20-year-old Victoria Magana Ledesma, told the&#x3C;span&#x3E;&#xA0;&#x3C;/span&#x3E;&#x3C;a href=&#x22;http://www.staradvertiser.com/2017/07/08/breaking-news/kona-coffee-farmer-says-goodbye-to-family-ahead-of-deportation/&#x22; target=&#x22;_blank&#x22;&#x3E;Honolulu Star Advertiser&#x3C;/a&#x3E;&#x3C;span&#x3E;&#xA0;&#x3C;/span&#x3E;on Saturday that the situation was &#x201C;more surreal than anything else.&#x201D;&#x3C;/p&#x3E;

&#x3C;p style=&#x22;text-align:start&#x22;&#x3E;&#x201C;We said our goodbyes at home. My dad decided it was better for my brother and my sister to not go all the way to the airport,&#x201D; Ledesma said. &#x201C;I don&#x2019;t feel like it&#x2019;s happening. And after so much fight that we went through, for it to just end like this. I mean, it&#x2019;s not necessarily ending, but it is hard to see him go.&#x201D;&#x3C;/p&#x3E;

<title>Hawaii coffee farmer wins last-minute stay of deportation, but his fight isn&#x27;t over just yet</title>
<link>https://www.dailykos.com/story/2017/6/9/1670289/-Hawaii-coffee-farmer-wins-last-minute-stay-of-deportation-but-his-fight-isn-t-over-just-yet</link>
<description>&#x3C;p&#x3E;&#x3C;span&#x3E;The&#x3C;/span&#x3E;&#xA0;Hawaiian coffee farmer who was the subject of a &#x3C;a href=&#x22;http://www.dailykos.com/story/2017/5/31/1667584/-Federal-judge-blasts-Trump-s-deportation-force-Even-the-good-hombres-are-not-safe&#x22; target=&#x22;_blank&#x22;&#x3E;&#x201C;remarkable&#x201D;&#x3C;/a&#x3E; concurrence from a federal judge last month&#x2014;&#x3C;span&#x3E;&#x201C;the government&#x2019;s decision to remove [Andres] Magana Ortiz shows that even the &#x2018;good hombres&#x2019; are not safe&#x201D;&#x2014;has won a&#xA0;last-minute&#xA0;reprieve&#xA0;from deportation.&#xA0;&#x3C;/span&#x3E;&#x3C;/p&#x3E;

&#x3C;p&#x3E;&#x3C;span&#x3E;Despite being a a well-respected businessman, taxpayer, and dad of three U.S. citizens,&#xA0;ICE ordered&#xA0;Magana Ortiz to leave after nearly three decades in the U.S. &#x3C;a href=&#x22;http://www.nbcnews.com/news/latino/coffee-farmer-gets-11th-hour-extension-day-deportation-n770051?cid=sm_npd_nn_tw_ma&#x22; target=&#x22;_blank&#x22;&#x3E;According to NBC News&#x3C;/a&#x3E;,&#xA0;Magana Ortiz had already boarded a plane to Honolulu to turn himself in to federal immigration agents when he found out he was given an additional 30 days in the country&#xA0;&#x3C;/span&#x3E;to attempt to sort out his legal status through a family petition, something he has been attempting to do for a year now.&#xA0;&#x3C;/p&#x3E;

&#x3C;p&#x3E;&#x3C;span&#x3E;It&#x2019;s a momentary relief for Magana Ortiz and his family, but their fight isn&#x2019;t over just yet:&#x3C;/span&#x3E;&#x3C;/p&#x3E;

&#x3C;blockquote&#x3E;
&#x3C;p&#x3E;&#x22;This is a temporary reprieve as the Department of Homeland Security considers Mr. Magana Ortiz&#x2019;s wife&#x2019;s Petition for Alien Relative,&#x22; said Hawaii Sen. Mazie K. Hirono in a statement.&#x3C;/p&#x3E;

&#x3C;p&#x3E;&#x201C;I call on the Department of Homeland Security to process the Magana Ortiz family&#x2019;s application to bring Andres out of the shadows as quickly as possible to keep Andres together with his wife and kids,&#x201D; she said.&#x3C;/p&#x3E;

&#x3C;p&#x3E;Magana Ortiz was relieved to hear he&#x27;d have a few more weeks with this family.&#x3C;/p&#x3E;

&#x3C;p&#x3E;&#x22;All I can say is that I&#x27;m pretty happy,&#x22; he said after the hearing. &#x22;It was very stressful. But I got a little bit of relief.&#x22;&#x3C;/p&#x3E;
&#x3C;/blockquote&#x3E;

&#x3C;p&#x3E;&#x3C;span&#x3E;Judge Stephen Reinhardt&#x2019;s passionate concurrence defending &#x3C;/span&#x3E;Magana Ortiz&#x3C;span&#x3E; went viral last month, with the federal judge&#xA0;rebuking&#xA0;Donald Trump and his administration&#xA0;for attempting to deport the dad despite his ongoing effort to gain legal status through his family members.&#x3C;/span&#x3E;&#x3C;/p&#x3E;

<title>Federal judge blasts Trump&#x27;s deportation force: &#x27;Even the good hombres are not safe&#x27;</title>
<link>https://www.dailykos.com/story/2017/5/31/1667584/-Federal-judge-blasts-Trump-s-deportation-force-Even-the-good-hombres-are-not-safe</link>
<description>&#x3C;p&#x3E;A federal judge rebuked&#xA0;the Trump regime for a decision&#xA0;to deport&#xA0;&#x3C;span&#x3E;an undocumented dad who has lived&#xA0;in the U.S. for nearly three decades. Andres Magana Ortiz had&#xA0;originally been ordered to leave by the Obama administration in 2011, but was granted permission to stay so that one of his family members&#xA0;could sponsor him. But under Donald Trump&#x2019;s mass deportation sweep,&#xA0;Magana Ortiz was again ordered to leave.&#xA0;Magana Ortiz&#xA0;went to the 9th&#x3C;/span&#x3E;&#x3C;span style=&#x22;text-align:start&#x22;&#x3E;&#x3C;span&#x3E;&#xA0;&#x3C;/span&#x3E;U.S. Circuit Court of Appeals in a last-ditch effort to&#x3C;/span&#x3E;&#x3C;span&#x3E;&#xA0;delay his deportation, but this week lost his case&#x3C;/span&#x3E;&#x3C;span&#x3E;.&#xA0;&#x3C;/span&#x3E;&#x3C;/p&#x3E;

&#x3C;p&#x3E;&#x3C;span&#x3E;However, one member of the court,&#xA0;&#x3C;/span&#x3E;&#x3C;span style=&#x22;text-align:start&#x22;&#x3E;Judge Stephen Reinhardt, &#x3C;a href=&#x22;http://www.slate.com/blogs/the_slatest/2017/05/30/judge_reinhardt_slams_trump_s_immigration_crackdown.html&#x22; target=&#x22;_blank&#x22;&#x3E;&#x201C;refused to let the case go quietly&#x201D;&#x3C;/a&#x3E;&#xA0;and in a &#x201C;remarkable&#x201D; concurrence&#x2014;written when someone agrees with a ruling but is compelled to make their own statement&#x2014;ripped&#xA0;&#x201C;t&#x3C;/span&#x3E;he government&#x2019;s insistence on expelling a good man from the country,&#x201D;&#xA0;writing&#xA0;that while&#x3C;span&#x3E;&#xA0;&#x201C;we do not have the authority to grant&#x201D; Magana&#x2019;s request to delay his deportation, &#x201C;we are not, however, compelled to find the government&#x27;s action in this case fair or just&#x201D;:&#x3C;/span&#x3E;&#x3C;/p&#x3E;

&#x3C;blockquote&#x3E;
&#x3C;p&#x3E;The government forces us to participate in ripping apart a family. Three United States citizen children will now have to choose between their father and their country. If they leave their homeland with their father, the children would be forced to move to a nation with which they have no connection. All three children were born in the United States; none has ever lived in Mexico or learned Spanish. Moving with their father would uproot their lives, interrupt their educations, and deprive them of the opportunities afforded by growing up in this country. If they remain in the United States, however, the children would not only lose a parent, but might also be deprived of their home, their opportunity for higher education, and their financial support.&#xA0;Subjecting vulnerable children to a choice between expulsion to a foreign land or losing the care and support of their father is not how this nation should treat its citizens.&#x3C;/p&#x3E;
&#x3C;/blockquote&#x3E;

&#x3C;p&#x3E;&#x201C;President Trump has claimed that his immigration policies would target the &#x2018;bad hombres,&#x2019;&#x201D; Judge&#xA0;&#x3C;span style=&#x22;text-align:start&#x22;&#x3E;Reinhardt plainly stated.&#x3C;/span&#x3E;&#xA0;&#x201C;The government&#x2019;s decision to remove Magana Ortiz shows that even the &#x2018;good hombres&#x2019;&#xA0;are not safe.&#x201D;&#x3C;/p&#x3E;
