$21 million isn&#x27;t much for a big, ol&#x27; massive government like ours.

<title>NY Times: Whistle-Blower Lawyers Throw Big Financial Support Behind Obama</title>

&#x3C;p&#x3E;Around Daily Kos, that&#x27;s a surprising headline. &#x26;nbsp;For several years there have been highly critical diaries accusing the Obama adminstration of cracking down on whistleblowers rather than supporting them. &#x26;nbsp;I don&#x27;t doubt that there has been some of that, but it appears that many of the attorneys who specialize in whistleblower lawsuits are giving big money to President Barack Obama&#x27;s campaign:&#x3C;br /&#x3E;&#x3C;/p&#x3E;
&#x3C;blockquote&#x3E;As the Obama administration has cracked down on corporate fraud, &#x3C;strong&#x3E;lawyers representing whistle-blowers have reaped multimillion-dollar rewards. Now, as they seek to sustain these historic payouts, they are serving as generous donors to the president&#x2019;s re-election campaign&#x3C;/strong&#x3E;.
&#x3C;p&#x3E;Lawyers in the tight circle who specialize in filing fraud claims with the federal government on behalf of clients with evidence of wrongdoing &#x3C;strong&#x3E;have raised more than $3 million so far for President Obama&#x3C;/strong&#x3E;. The administration, meanwhile, has paid out $1.6 billion to whistle-blowers during his tenure, with law firms taking a cut in some cases of up to 40 percent of the proceeds.&#x3C;/p&#x3E;
&#x3C;p&#x3E;The lawyers have contributed directly to Mr. Obama&#x2019;s campaign, served as &#x201C;bundlers&#x201D; who solicit contributions from others, donated to the Democratic National Committee and written large checks to Priorities USA, the &#x201C;super PAC&#x201D; supporting Mr. Obama&#x2019;s re-election efforts. They have also donated heavily to Congressional Democrats.&#x3C;br /&#x3E;&#x3C;/p&#x3E;

&#x3C;p&#x3E;Well, &#x3C;a href=&#x22;http://www.bloomberg.com/news/2012-08-30/j-j-will-pay-181-million-to-settle-risperdal-ad-claims.html&#x22;&#x3E;some modern-day hucksters got busted today&#x3C;/a&#x3E; by a bipartisan coalition of 36 states&#x2019; atty. Generals (Bloomberg):&#x3C;/p&#x3E;
&#x3C;blockquote&#x3E;Johnson &#x26;amp; Johnson (JNJ) will pay $181 million to resolve claims by 36 states that it improperly marketed and advertised the antipsychotic drugs Risperdal and Invega.&#x3C;br /&#x3E;
J&#x26;amp;J and its Janssen unit settled claims that it promoted the drugs from 1998 through 2004 for uses not approved by the U.S. Food and Drug Administration.
&#x3C;p&#x3E;New York Attorney General Eric Schneiderman said today the accord is the largest multistate consumer protection-based pharmaceutical settlement.&#x3C;br /&#x3E;

The U.S. has been probing Risperdal sales practices since 2004. J&#x26;amp;J disclosed in August 2011 that it reached an agreement to a misdemeanor criminal charge over Risperdal marketing.&#x3C;/p&#x3E;
&#x3C;p&#x3E;The FDA approved Risperdal in 1993 for psychotic disorders including schizophrenia. That market is limited, and Janssen unit sought to sell Risperdal for bipolar disorder, dementia, mood and anxiety disorders and other unapproved uses, according to court filings. It was later approved for other uses.&#x3C;/p&#x3E;
&#x3C;/blockquote&#x3E;
Although &#x3C;em&#x3E;this&#x3C;/em&#x3E; lawsuit originated from the states, it reminds us that throughout the first Obama term, aggressive enforcement of Big Pharma&#x2019;s abuses has paid dividends for consumers and used a variety of innovative regulatory strategies working with state governments across the political spectrum. While maybe a tad abstract for political advertising, this is nonetheless a common-sense issue that demonstrates a sector where the Obama administration has shown the power of aggressively competent oversight.&#x3C;br /&#x3E;

&#x3C;p&#x3E;The University of Alabama at Birmingham (UAB) announced recently that it was &#x3C;a href=&#x22;http://legalschnauzer.blogspot.com/2009/06/mismanagement-continues-at-uab-with-245.html&#x22;&#x3E;eliminating 245 jobs&#x3C;/a&#x3E; in its health-care operation. The plan, which resulted in the termination of 164 employees, is &#x3C;a href=&#x22;http://blog.al.com/businessnews/2009/06/university_of_alabama_at_birmi_1.html&#x22;&#x3E;expected to save $16 to $20 million a year&#x3C;/a&#x3E;.&#x3C;/p&#x3E;

&#x3C;p&#x3E;That leaves this glaring question, one UAB obviously does not want raised publicly: What happened to the estimated $300 to $600 million that UAB allegedly pilfered from the federal government in a massive research-fraud scheme that lasted for approximately 10 years, starting in the 1990s?&#x3C;/p&#x3E;

&#x3C;p&#x3E;In other words, &#x3C;a href=&#x22;http://legalschnauzer.blogspot.com/2008/10/what-happened-to-uabs-dirty-money.html&#x22;&#x3E;what happened to UAB&#x27;s dirty money&#x3C;/a&#x3E;?&#x3C;/p&#x3E;

&#x3C;p&#x3E;The False Claims Act Correction Act of 2007 [covered below] is intended as a vehicle to correct loopholes in the &#x3C;a href=&#x22;http://en.wikipedia.org/wiki/False_Claims_Law&#x22;&#x3E;False Claims Act&#x3C;/a&#x3E;, a law that permits private citizens to file suit against contractors who defraud the federal government. The Act has been the most effective anti-fraud law in American history having recovered over $20 billion in ill-gained taxpayer dollars over the past 20-years.&#x3C;/p&#x3E;
