The truth be told, this is an absurdly unimpressive selection by Bush. However, there is one and only one smart play by the Democrats here--and that is to offer 'tough' questioning and then vote en masse to confirm Miers as the next Justice on the SCOTUS.

Why?

I have two words for you (below the flip):

2006.

Turnout.

As one can see from around the wingnutosphere, the social conservatives are feeling betrayed and violated. There is palpable disgust with someone who is neither a Scalia/Thomas fellow traveler nor a well-qualified jurist.

Turnout.

But, Bush is a lame duck. There's really very damn little that they can do to punish Bush.

However, having a Republican president once again ignore their #1 issue--the judiciary--will have an effect on

2006 turnout.

Do you want a surefire way to demoralize Bush's base in 2006? How about having Bush's choice for the SCOTUS--the key to their social agenda--getting more enthusiastic support from Harry Reid and Chuck Schumer than from mainstream Republicans?

Confirm her, and we take Congress back in 2006.

P.S. This would also be a good way of torpedoing McCain and Giuliani in the 2008 Republican primaries. That is, if you'd rather face someone like Sam Brownback in the general election.
