Louisiana Attorney General Charles Foti has decided against issuing a ruling on whether former U.S. Senator John Breaux can run for governor.

Foti continues,
"I must refrain from rendering an opinion on the ultimate issue of whether Mr. Breaux meets the qualifications to become a candidate in the governor's race," Foti said.
This was expected by Foti, he was going to have a lawsuit brought against him by the Dems or the Repubs depending on which side he took on the issue and he certainly did not want that.
He is passing the buck to the courts and now Breaux has a limited amount of time to get a ruling before the qualifying date (a few months away).
And as bayoubuzz.com has already noted, if Breaux does get a favorable declaratory judgement, Republicans will appeal and try to block his qualification essentially tying Breaux up in the courts until it is too late to run.
The clock is now ticking on Breaux.
