The United States is currently operating under three individual Declarations of National Emergency. The purpose of a Declaration of National Emergency is as follows:
(a) With respect to Acts of Congress authorizing the exercise, during the period of a national emergency, of any special or extraordinary power, the President is authorized to declare such national emergency. Such proclamation shall immediately be transmitted to the Congress and published in the Federal Register. (b) Any provisions of law conferring powers and authorities to be exercised during a national emergency shall be effective and remain in effect

In past declarations of war Habeus Corpus was suspended by executive declaration. Now, U.S. citizens may be targeted for assassination by executive order. What other rights do we think we have but do not?
When a National Emergency is declared, the President of the United States has the right to invalidate any U.S. Laws for the purpose of dealing with this national emergency.
Any laws at all.
This is why we can now discuss whether or not is was right to mirandize terrorists who are captured in the U.S. Constitutional law dictates that all suspected criminals, whether they are citizens or not, must be mirandized. It is called "due process". Now the pundits on Morning Joe seem to think that it should be based on whether a person is born in the U.S. or if they are foreign born.

The reasone we need to figure out the new rules is exactly because there are new rules. That is right, the constituional rights afforded to citizens are currently in suspension following the needs of the federal government to exercise special and extraordianry power to prosecute a response to the proclaimed national emergency.
