Teacherken put up a diary regarding Himself’s call to vote on multiple ballots in Colorado.
One commenter replied to numerous people saying that, should that happen, the original ballots would automatically be voided (which is true). What this commenter neglects to mention is that, by requesting and voting on a replacement ballot, a voter is swearing, under law, that the first ballot was never submitted and that the voter’s intent was never recorded nor intended to be.
I swear or affirm that I am requesting the replacement ballot for the reasons stated above, that I have not voted the original
ballot issued for the election indicated and I do not intend to vote at the election except by voting the replacement ballot.
The intent, and implications, of the affirmation are clear: there was a mistake in filling out the original ballot, which was never submitted (“I have not voted the original ballot”).
By issuing the call to his supporters to vote multiple ballots, he is indeed calling on them to commit a felony under the laws of the State of Colorado, and pay the penalties for that felony themselves.
To be clear: whether or not the Secretary of State voids the original ballot, the voter’s affirmation on the replacement ballot opens him or her to penalties under the law. You can be sure, with elected officials pussyfooting around every otherwise prosecutable statement Himself has made during this campaign, that he will not pay the price for these felonies.
Those who follow his call, however, do not enjoy the same immunity-by-spinelessness-on-the-part-of-law-enforcement.
