The Constitution of the United States
Our Constitution’s very core, its heart of gold if you will, as set out in the Preamble, is being violated.
Here follows a summary of the current state of our union, and a call to action:
Preamble
The Foundation is solid, but shaken to its core from within and without.
We the People of the United States, in Order to form a more perfect Union,
We the People have never been as polarized and divided into as many factions as we are right now.
establish Justice,
It is more than clear to We the People that many, many laws have been and are being broken by many, many people. Among the investigations ongoing: the FBI, Senate Intel, House Intel, House Oversight, Senate Judiciary, AGNY ; the charges levied include treason, corruption, obstruction of justice, violation of the emoluments clause, money laundering, to name a few of the most grievous.
insure domestic Tranquility,
There is no tranquility in our country. Rage rules our roads and lurks in every corner. People and their rights are being attacked for reasons beyond their control as well as for their personal choices. We are being willfully, purposefully and ceaselessly provoked from all sides towards unrest so that martial law may be implemented, authoritarian rule cemented.
provide for the common defence,
We are under attack from without and within, and on a minute to minute daily basis. We are increasingly at risk, vulnerable. Our defenses have been breached, we are engaged in cyberWARfare. Recently, several highly regarded officials (Comey, Yates, Clapper) have under oath stressed the urgency of the situation.
promote the general Welfare,
Our welfare is not only not being promoted it is under fire: health care should, could be like calling 911, when you need it is there and it is already paid for by We The People; the very air we breathe, water we drink and food we eat are at risk as the environment is under attack, along with education, net neutrality, Social Security and Medicare, etc. ad nauseum.
and secure the Blessings of Liberty to ourselves and our Posterity,
Many many people are not feeling free to go about the pursuit of happiness right now; we are not free to trust that our elected officials are doing the job they were elected to do. We are terrified for our children, grandchildren, terrified for everyone, and everyone’s posterity.
do ordain and establish this Constitution for the United States of America.
These most elegant bold words of the Preamble describe, define and embrace that order which was established after our independence was won, our independence which had been paid for with the blood of patriots, the sweat of the citizenry and the tears of too many mothers.
The right to use the word “ordain” was not given by God, but provided by the blood, sweat and tears extracted by the fighters of the Revolution.
That decree and their effort deserves, demands the greatest possible defense we can muster. We must rally and prevail else our precious democratic experiment be extinguished.
How can we do that? We all know that where there is a will there is a way. The “will” is what we have to summon, and we have to do so immediately: our elected officials are not abiding by their oath to support and defend the Constitution.
Here are the ways the Constitution provides for the removal of our elected officials:
Section 4 - Disqualification
The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.
And also here:
Amendment 25 - Presidential Disability and Succession. Ratified 2/10/1967.
4. Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.
The Constitution is upheld by sworn oaths:
The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution
The Constitution further guarantees protection against invasion:
Article 1V, Section 4 - Republican government
The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion
Every right, provision, oath and guarantee set out by the Constitution has been violated by the Executive Branch. By not removing this threat to our national security, all our elected officials in the Legislative and Judicial Branches are violating their Oath, and so are aiding and abetting, they are all accessories to the rape and murder of our beloved Lady Liberty.
The founding forefathers could not foresee many things, such as cyberwarfare, but did believe means must be invented when necessary; indeed that is the basis for revolution.
Why go to all that trouble when all we need do is peacefully transfer power to a person willing and able to uphold the Constitution, a person willing to stand by their Oath to do so?
It is obvious an independent prosecutor needs to sort out this sordid affair. But what may not be so obvious to all of us is that the Elephant in the Room is trumpeting as it is fast crushing our democracy. A sense of urgency seems to be ...lacking.
Yes, it is hard to find our way, to find the fire that we need to first address in this Smoke Filled House of Mirrors. The fire is everywhere, there is no more time to ask how hot, what kind, who started it…what would a firefighter do?
Put the fire out first and investigate for arson second. The time is at hand to remove the threat(s).
Our elected officials are not abiding by their Oath to support and defend the Constitution.
It will be a matter of the historical record who has not upheld their Oath.
Investigations can determine what laws have been broken, and courts will see that Justice is served.
We will vote again, and again and again.
Right now fire extinguishers in brigade formation united to fight are what we need to become, not fire starters, as we need to:
Impeach all elected officials violating the Constitution and not upholding their oath or even better yet, nullify the election based on the guarantee clause, the tool we have never used. Let us have a new election.
Then investigate via a special prosecutor and prosecute all complicit to the full extent of the law. Enact sweeping reform to protect our democracy from without and within.
Death used to be the penalty for treason by an elected official, that was taken off the table. Now it is no less than 5 years in prison and a fine of $10,000, and the loss of the right to hold office, the right to ever again swear an Oath to uphold the Constitution of the United States.
