Buzzfeed had an article with the full text of a Trump NDA: Buzzfeed: full text of a Trump NDA. It is worth reading the whole thing.
The Daily Dot states that everyone in the Trump campaign, even a volunteer making phone calls had to sign the NDA. This was known at the time, but not widely publicized. It was shocking to me then and now.
Here is an excerpt:
2. No Disparagement. During the term of your service and at all times thereafter you hereby promise and agree not to demean or disparage publicly the Company, Mr. Trump, any Trump Company, any Family Member, or any Family Member Company or any asset any of the foregoing own, or product or service any of the foregoing offer, in each case by or in any of the Restricted Means and Contexts and to prevent your employees from doing so.
It is binding till the end of time. It also requires the person to inform Trump of any legal obligation to reveal confidential information and not to disclose that information until Trump’s lawyers have time to go to court to stop the disclosure.
The Weekly Standard has an article on Trump’s attempt to enforce the NDA against Bannon.
It is not likely that these NDAs are enforceable. I wonder what Mueller will say if a witness tells him that he has to inform Trump before he can reveal information to him or to the Grand Jury. Flynn and Papadopoulis must have violated these NDAs; I doubt that Trump will sue them.
Trump loves to sue people and to threaten to sue them. But, a civil law suit can be dangerous to him because it opens him up to the discovery process. Imagine Trump having to testify under oath against Bannon.
