This is a link to the PDF of the memorandum from Arizona prosecutor Rachel Mitchell to the Senate Judiciary Committee.
Don’t take it at face value. It is worth a careful reading.
My impression is that she indeed has pointed out a number of inconsistencies in Dr. Christine Blasey Ford’s accounts of her assault, both prior to and during her testimony.
As a so-called expert in such cases, she demonstrates little if any appreciation as to how trauma victims misremember or don’t recall certain details of the traumatic event.
She knows full well that as a prosecutor she would almost always have a mental health expert in trauma and PTSD testify on behalf of the victim to explain the reasons a victim may not have perfect memories of an event whether recent or decades old. Instead of writing a report I’d expect from a prosecutor, she writes as if she is the defense attorney for the accused.
Her ultimate conclusion is that based on the information she had if this was her case she would not recommend taking it to trial.
The major issue I raise is that many of the questions she raises require further law enforcement investigation.
What she doesn’t say is whether if this was her case, would she have asked the police experts assigned to her who likely are experts in sexual abuse investigations, to fill in the gaps.
I have a little experience in how these investigations are done from having been a member child abuse investigation team in Clinton County, Michigan. The team (we called it the Child Abuse and Neglect Council) was composed of relevant agency directors. I was the mental health center director. The other members were the head country detective, the Friend of the Court, the director of the juvenile court service, the chief assistant prosecutor, and the director of the Protective Services Department. We met once a month and went over policy matters and individual cases.
In a case like Dr. Ford’s, we would have assigned our expert investigators to fill in the gaps and inconsistencies in her memory and interview all relevant witnesses.
