When President Franklin D. Roosevelt was faced by a conservative-leaning Supreme Court that threatened to derail his New Deal programs in the 1930s, he proposed a controversial plan — to pack the Supreme Court with up to 6 more justices. He received blowback for this idea and it was never approved by Congress. Fortunately for FDR, and for the country, the Court began to uphold New Deal laws by narrow votes, and then FDR got to pick new justices that were liberal leaning.
FDR received criticism because his plan would “politicize” the Court. At the time, this may have been a valid criticism. But we’re living in very different times today. We’re way past the time of the Court being “politicized.” Heck, Mitch McConnell made the Court a centerpiece of the 2016 election by blocking Merrick Garland’s nomination to SCOTUS, claiming voters should be able to weigh in on the matter via the election.
I think we Dems need to do what FDR proposed back in the 1930s. Next time we have control of the presidency and Congress, we need to pass legislation that raises the number of SCOTUS justices from 9 to 11. This would essentially cancel out the two justices Trump gets to appoint (let's hope it's only 2 and not more), and would ensure that the Court’s slide to the right is negated. If, God forbid, Trump gets to appoint even more justices to SCOTUS due to future vacancies, then let's raise the number up to 13 or even the 15 justices that FDR wanted.
Yes, I realize that Republicans would raise bloody hell if Democrats did this and we would be criticized for politicizing SCOTUS (as if it hasn't already been politicized). But, as Melania’s jacket said: “I really don't care. Do U?"
NOTE: One big caveat about this idea — we Dems MUST win back Congress and the Executive branch for this to happen. It CAN be done.
