As Trump made his decision to pull support to the Kurds, he was fully aware that ISIS fighters would be released from imprisonment. This action was cold and calculated. Trump was bred and weaned on Roy Cohn’s limitless ruthless and treacherous philosophy of destroying any opposition and threats to his existence by any means necessary.
At the time of Trump’s decision, Trump had received a phone call from Erdogan advising him that Erdogan wanted to go after the Kurds, and I would not be surprised that the topic of the safe, protected status of Trump’s Turkey Towers was mentioned. At approximately 6:00 pm PST, that evening, the story about Team Trump’s Naftogaz LNG scheme dropped. Now, this Naftogaz scheme is a red hot, full on RICO grade scam, with potential penalties exceeding even the risks derived from Trump’s Biden investigation extortion operation. Under these triple threats to Trump, he did what his Roy Cohn “education” prepared him for. He unleashed his maximum damage, scorched earth assault. Set free ISIS to reform and renew their Jihad against Western countries. End result for Trump, this takes media coverage of away from his Ukraine problems, lowers any threat to his Turkey Tower and placates Erdogan. After the first day of the Naftogaz scheme went public, there has been no further media coverage of this scam. All the while empowering his pay back punishment against opponents’ investigations and possible prosecution of him.
In true Roy Cohn fashion, which would make his mentor proud, Trump is essentially waging war against America, causing as much damage, destruction, and carnage as he possibly can in the form of retribution and genocide of the Kurds, along with the regeneration of ISIS. If he is going down, he plans on taking everyone and everything down with him. This is reflected in a tweet he sent out this week in which he bragged about causing as much chaos as he can. Trump’s release of ISIS to wage Jihad was willful and intentional. America has been, is, and will be in a state of war against ISIS. ISIS is an enemy of America. Donald Trump, by freeing ISIS, gave aid and comfort to America’s enemy. Donald Trump did willfully and intentionally commit Treason when he pulled support to the Kurds.
Treason is the only crime identified and defined in the Constitution of the United States, and it is extremely narrow in its limits and boundaries. This is the definition as stated in the Constitution:
U.S. Constitution - Article 3 Section 3
Article 3 - The Judicial Branch
Section 3 – Treason
Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.
This is how Treason appears in U.S. Code:
18 U.S. Code § 2381 - Treason
Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.
(June 25, 1948, ch. 645, 62 Stat. 807; Pub. L. 103–322, title XXXIII, § 330016(2)(J), Sept. 13, 1994, 108 Stat. 2148.)
The charge of Treason can only be invoked in the case of war. Meaning that the United States must be engaged in a declared war or in an on-going state of war with an identifiable group actively conducting warfare against the United States. It is indisputable that the Islamic Terrorist organization has been, presently is, and will be conducting warfare against the United States. There is no question whatsoever that America is at war against ISIS. This state of War fulfills the first requirement necessary for a charge of Treason to be filed.
Editor Note: Comments have been made below stating that the “state of war” criteria is not fulfilled in my argument. Following is why I argue that my argument meets this criteria.
1. The U.S. military actions against ISIS are war actions. The U.S. is engaged in warfare against ISIS as defined by the label “War on Terror”, which is carried out under the War authorization for the Afghanistan/Iraq wars. That would meet the State of War requirement.
2. The Treason clause does not specify that the “State of War” be addressed/limited to a nation. It does not mention the term/concept “Nation”. It is and can be against “enemies”. ISIS meets the criteria of “enemies”.
The second requirement necessary for a Treason prosecution is “giving aid and comfort to the (our) enemy..”.
In the ongoing war in Syria, where ISIS fighters have congregated en masse, and established a Caliphate, the Kurds, as American surrogates, and in conjunction with American military support, have fought, defeated, and imprisoned thousands of ISIS fighters and their top leaders. All of whom pose a violent, war type threat to America. The Kurds, our American allies, partners, and surrogates have maintained control over the imprisonment of these ISIS fighters. By his instantaneous withdrawal of American military support and protection to/for the Kurds, Trump is directly responsible for the rapid destruction of the ISIS imprisonment system, which is resulting in their escape, and will lead to their eventual renewed and intensified attacks on and against America. This is the definition of “giving aid and comfort to the enemy”.
The shear grotesqueness of Trump’s actions are becoming worse by the hour. Much has been spoken of and written about how Trump has enabled the genocide of the Kurd population. Perhaps he can be considered an accomplice in Crimes Against Humanity on that. All of these despicable actions by Trump seem to be driven by his own self-aggrandizement and preservation, due to his illegal machinations and financial ambitions in Turkey. To Trump, other human lives are expendable commodities of no value whatsoever, except whatever financial he can gain form others deaths.
But back to the Crime of Treason. Trump’s criminal actions, since taking office, have been protected from prosecution, by the specious, non-legally established meme that a sitting President cannot be indicted nor prosecuted. Plus the fact that William Barr, the U.S. Attorney General, is dedicated to protecting Trump from criminal prosecution.
Now, The Act of Treason against the United States, by this sitting President, with the certain guarantee that violent attacks against America will result in his actions, and the seemingly obvious prediction that his treasonous acts against this country will continue, as long as he is in office, must be dealt with. America cannot wait until a sure to fail Senate Impeachment trial happens or the 2020 election to stop Trump’s carnage against America. Trump is bound and determined to destroy as much of America as he can
So what can be done to stop Trump’s war on America?
Unfortunately, Trump will not be prosecuted by the DOJ while Barr is the A.G.
It would be good to add Treason to the Articles of Impeachment, but I seriously doubt that will be done.
But it is important that Treason by Trump is kept on the table, for when The GOP no longer has the Presidency. Trump must be prosecuted for Treason for the damage and carnage he has and will cause to America.
